relating to education finance; appropriating money to schools that provide in-person
instruction during the 2020-2021 school year.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

The appropriation in Minnesota
Statutes, section 4.07, subdivision 3, does not apply to $....... of federal funds for COVID-19
from the Elementary and Secondary School Emergency Relief Fund's state educational
agency reserve received by the state of Minnesota between December 26, 2020, and June
30, 2023, for which an appropriation in this section is an eligible expenditure. Federal
funding to which this section applies must not be used for any other purpose.

$....... in fiscal year 2021 is appropriated from the federal fund
to the commissioner of education to support school districts that have provided in-person
instruction during the 2020-2021 school year as of December 31, 2020. The commissioner
must allocate the appropriation in this subdivision to each eligible school district in an
amount equal to the total appropriation multiplied by the ratio of an eligible school district's
fiscal year 2021 average daily membership divided by the total fiscal year 2021 average
daily membership of all eligible school districts. The commissioner must use the estimated
average daily membership from the November 2020 forecast for the funding allocation
under this subdivision. This appropriation is available until September 30, 2023. This is a
onetime appropriation.

The sums indicated in this section are
appropriated from the general fund to the Department of Education in the fiscal years
designated.

(a) For providing grants to school districts that
have conducted in-person learning throughout the 2020-2021 school year:

(b) To be eligible for funding under this subdivision, a school district must document
that its coronavirus-related costs exceed the amount of federal revenue it received under
the Coronavirus Aid, Relief, and Economic Security Act (Public Law 116-136) and the
Coronavirus Response and Relief Supplemental Appropriations Act (Public Law 116-260).
School districts must make this documentation in a form and manner determined by the
commissioner. The commissioner must distribute grants equally to eligible school districts
based on each school district's average daily membership for the 2020-2021 school year.
A grant awarded under this subdivision must be used for costs associated with reopening
and providing in-person learning.
