  1.1                          A bill for an act 
  1.2             relating to retirement; making the surviving spouses 
  1.3             of certain police officers eligible for survivor 
  1.4             benefits from the public employees retirement 
  1.5             association police and fire fund. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [SURVIVOR BENEFITS.] 
  1.8      (a) Notwithstanding Minnesota Statutes, section 353A.08, 
  1.9   the surviving spouse of a person described in paragraph (b) is 
  1.10  entitled to receive survivor benefits provided under the 
  1.11  relevant provisions of the public employees retirement 
  1.12  association police and fire fund benefit plan. 
  1.13     (b) This section applies to the surviving spouse of a 
  1.14  person who was: 
  1.15     (1) employed as a police chief by the city of West St. 
  1.16  Paul; 
  1.17     (2) an active member of the West St. Paul police relief 
  1.18  association on February 8, 1993, when the governing body of West 
  1.19  St. Paul, in accordance with Minnesota Statutes, section 
  1.20  353A.04, subdivision 5, gave preliminary approval to the 
  1.21  consolidation of the association with the public employees 
  1.22  retirement association; 
  1.23     (3) whose intention, upon consolidation, to elect benefits 
  1.24  provided under the relevant provisions of the public employees 
  1.25  retirement association police and fire fund benefit plan was 
  2.1   recognized by the governing body of West St. Paul in a 
  2.2   resolution adopted March 16, 1994; 
  2.3      (4) who died in April 1993, before the governing body of 
  2.4   West St. Paul, on August 23, 1993, gave final approval to the 
  2.5   consolidation in accordance with Minnesota Statutes, section 
  2.6   353A.04, subdivision 8; and 
  2.7      (5) who was thus unable, before his death, to carry out his 
  2.8   intent to elect public employees retirement association benefits 
  2.9   under Minnesota Statutes, section 353A.08. 
  2.10     Sec. 2.  [EFFECTIVE DATE.] 
  2.11     Section 1 is effective the day after compliance with 
  2.12  Minnesota Statutes, section 645.021, subdivision 2, by the 
  2.13  governing body of the city of West St. Paul.
