  1.1                          A bill for an act 
  1.2             relating to highways; requiring commissioner of 
  1.3             transportation to construct pedestrian-bicycle 
  1.4             overpass on marked trunk highway No. 36 in North St. 
  1.5             Paul. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [TRUNK HIGHWAY 36 OVERPASS.] 
  1.8      Subdivision 1.  [CONSTRUCTION REQUIRED.] As part of the 
  1.9   commissioner's trunk highway work program for the fiscal year 
  1.10  ending June 30, 1999, the commissioner of transportation shall 
  1.11  construct an overpass suitable for pedestrians and bicycles over 
  1.12  marked trunk highway No. 36 in North St. Paul, to be located 
  1.13  between the trunk highway's intersections with Margaret Street 
  1.14  and First Street.  The commissioner shall apportion the cost of 
  1.15  the overpass between the department of transportation and the 
  1.16  department of natural resources.  The commissioner shall 
  1.17  construct the bridge according to the design of the commissioner 
  1.18  of natural resources.  The commissioner of transportation shall 
  1.19  take all steps necessary to secure federal funding for a portion 
  1.20  of the costs of the overpass. 
  1.21     Subd. 2.  [TRUNK HIGHWAY 36 RECONSTRUCTION.] The 
  1.22  commissioner need not comply with subdivision 1 if the 
  1.23  commissioner's trunk highway work plan for the fiscal year 
  1.24  ending June 30, 1999, includes a reconstruction of that part of 
  1.25  marked trunk highway No. 36 located in North St. Paul, and the 
  2.1   reconstruction includes a pedestrian-bicycle overpass within the 
  2.2   city.
