  1.1                          A bill for an act 
  1.2             relating to human services; prohibiting the 
  1.3             commissioner from using expunged records as a basis 
  1.4             for disqualifying a person applying for a license 
  1.5             under the department of human services licensing act; 
  1.6             amending Minnesota Statutes 2000, section 245A.04, by 
  1.7             adding a subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 245A.04, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 3e.  [EXPUNGED RECORDS.] The contents of a police or 
  1.12  court record that has been expunged under chapter 609A must not 
  1.13  be used by the commissioner as a basis for disqualification 
  1.14  under this section. 
  1.15     Sec. 2.  [EFFECTIVE DATE.] 
  1.16     This act is effective the day following final enactment.
