A bill for an act
relating to urban riverfronts; requiring a model ordinance.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin URBAN RIVERFRONT MODEL ORDINANCE.

new text begin By July 1, 2009, the Environmental Quality Board shall develop a model ordinance
that will specify the technical and administrative procedures to guide sustainable
development and redevelopment along urban riverfronts in the state. The model ordinance
must address the requirements of shoreland, flood plain, critical areas, and wild and scenic
rivers and related law and rule. When adopted by a local unit of government, the model
ordinance is the minimum regulation to guide urban riverfront development. Upon
completion of the model ordinance, the Environmental Quality Board shall notify local
units of government that the model ordinance is available, and must make the model
ordinance available on its Web site and distribute it as appropriate.

new text begin Upon completion of the ordinance in section 1, the commissioner of administration
shall identify any building code changes necessary for implementation of urban riverfront
development.

new text begin The Environmental Quality Board and commissioner of administration shall:

new text begin (1) consult and utilize the report "Connecting with Minnesota's Urban Rivers"
prepared under Laws 2001, First Special Session chapter 10, article 1, section 11, for
both sections 1 and 2;

new text begin (2) review the waterfront development results in urban areas outside of Minnesota
and the United States and integrate appropriate features of those areas into the model
zoning ordinance and building code; and

new text begin (3) recommend appropriate amendments to existing law for implementing the
features of the model ordinance and building code.
