  1.1                          A bill for an act
  1.2             relating to health occupations; modifying the criteria 
  1.3             for regulating health occupations; amending Minnesota 
  1.4             Statutes 1996, section 214.001, subdivision 2. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 214.001, 
  1.7   subdivision 2, is amended to read: 
  1.8      Subd. 2.  [CRITERIA FOR REGULATION.] The legislature 
  1.9   declares that no regulation shall be imposed upon any occupation 
  1.10  unless required for the safety and well being of the citizens of 
  1.11  the state.  In evaluating whether an occupation shall be 
  1.12  regulated, the following factors shall be considered: 
  1.13     (a) Whether the unregulated practice of an occupation may 
  1.14  harm or endanger the health, safety and welfare of citizens of 
  1.15  the state and whether the potential for harm is recognizable and 
  1.16  not remote; 
  1.17     (b) Whether the practice of an occupation requires 
  1.18  specialized skill or training and whether the public needs and 
  1.19  will benefit by assurances of initial and continuing 
  1.20  occupational ability; 
  1.21     (c) Whether the citizens of this state are or may be 
  1.22  effectively protected by other means; and 
  1.23     (d) Whether the overall cost effectiveness and economic 
  1.24  impact would be positive for citizens of the state; 
  1.25     (e) Whether regulating the occupation would facilitate or 
  2.1   hinder citizen access to individuals engaging in the occupation; 
  2.2   and 
  2.3      (f) Whether the quality of services provided to citizens 
  2.4   would be or is likely to be higher.
