1.1 A bill for an act 1.2 relating to natural resources; modifying provisions 1.3 for a timber permit extension; amending Minnesota 1.4 Statutes 1996, section 90.193. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 1996, section 90.193, is 1.7 amended to read: 1.8 90.193 [EXTENSION OF TIMBER PERMITS.] 1.9 (a) The commissioner may, in the case of an exceptional 1.10 circumstance beyond the control of the timber permit holder 1.11 which makes it unreasonable, impractical, and not feasible to 1.12 complete cutting and removal under the permit within the time 1.13 allowed, grant an extension of one year. A request for the 1.14 extension must be received by the commissioner before the permit 1.15 expires. The request must state the reason the extension is 1.16 necessary and be signed by the permit holder.The value of the1.17timber remaining to be cut will be recalculated using current1.18stumpage rates. Any timber cut during the period of extension1.19or remaining uncut at the expiration of the extension shall be1.20billed for at the stumpage rates determined at the time of1.21extension provided that in no event shall stumpage rates be less1.22than those in effect at the time of the original sale. An1.23interest rate of eight percent will be charged for the period of1.24extension.1.25 (b) If the commissioner has directed the timber permit 2.1 holder not to cut timber for all or part of an operating season, 2.2 as described in the permit, the commissioner shall grant a 2.3 one-year extension.
