  1.1                          A bill for an act 
  1.2             relating to crime prevention; providing that 
  1.3             preventing a commission of a felony by a trespasser is 
  1.4             justifiable homicide; amending Minnesota Statutes 
  1.5             1996, section 609.065. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 609.065, is 
  1.8   amended to read: 
  1.9      609.065 [JUSTIFIABLE TAKING OF LIFE.] 
  1.10     The intentional taking of the life of another is not 
  1.11  authorized by section 609.06, except when necessary in resisting 
  1.12  or preventing an offense which the actor reasonably believes 
  1.13  exposes the actor or another to great bodily harm or death, or 
  1.14  preventing the commission of a felony by a trespasser as defined 
  1.15  in section 609.605, subdivision 1, paragraph (b), clause (3), 
  1.16  (4), or (7), in the actor's place of abode. 
  1.17     Sec. 2.  [EFFECTIVE DATE.] 
  1.18     Section 1 is effective August 1, 1998, and applies to 
  1.19  crimes committed on or after that date.
