A bill for an act
relating to employment; establishing a cause of action for damages incurred from
mandatory immunization; proposing coding for new law in Minnesota Statutes,
chapter 181.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [181.899] CIVIL ACTION; MANDATORY IMMUNIZATION.

new text begin (a) An employee may bring a civil action at any time in district court for damages against
the employee's employer if the employer required the employee to receive an immunization
and the employee experienced serious illness or injury as a result of the immunization. The
court shall award actual damages and reasonable attorney fees and costs to a prevailing
plaintiff.

new text begin (b) For the purposes of this section, "employee" has the meaning given in section 181.950,
subdivision 6, and includes an unpaid intern or volunteer treated as an employee for purposes
of a vaccination mandate.

applies retroactively to causes of actions arising on or after January 1, 2021.
