A bill for an act
relating to education; permitting nonunion teacher contracts; amending
Minnesota Statutes 2008, sections 122A.40, by adding a subdivision; 179A.03,
subdivision 2; repealing Minnesota Statutes 2008, section 179A.06, subdivision
3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 122A.40, is amended by adding a
subdivision to read:

new text begin Unrepresented teachers. new text end

new text begin Notwithstanding any law to the contrary,
a school board may hire and contract with an individual teacher not represented by the
exclusive representative of the teachers of that district. If a district hires a teacher not
represented by the exclusive representative of the teachers of the district, the teacher is the
exclusive representative for purposes of chapters 120A to 129 and 179A.

Sec. 2.

Minnesota Statutes 2008, section 179A.03, subdivision 2, is amended to read:


Subd. 2.

Appropriate unit.

"Appropriate unit" or "unit" means a unit of employees
determined under sections 179A.09 to 179A.11. For school districts, the term means all
