  1.1                          A bill for an act
  1.2             relating to crime; expanding the scope of certain 
  1.3             felony penalties for the crime of obstructing legal 
  1.4             process; amending Minnesota Statutes 1996, section 
  1.5             609.50, subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 609.50, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [PENALTY.] A person convicted of violating 
  1.10  subdivision 1 may be sentenced as follows: 
  1.11     (1) if the act was committed with knowledge that it created 
  1.12  a risk of death, substantial bodily harm, or serious property 
  1.13  damage, or if the act involved the intentional disarming of a 
  1.14  peace officer by taking or attempting to take the officer's 
  1.15  firearm from the officer's possession without the officer's 
  1.16  consent, to imprisonment for not more than five years or to 
  1.17  payment of a fine of not more than $10,000, or both; 
  1.18     (2) if the act was accompanied by force or violence or the 
  1.19  threat thereof, and is not otherwise covered by clause (1), to 
  1.20  imprisonment for not more than one year or to payment of a fine 
  1.21  of not more than $3,000, or both; or 
  1.22     (3) in other cases, to imprisonment for not more than 90 
  1.23  days or to payment of a fine of not more than $700, or both.  
  1.24     Sec. 2.  [EFFECTIVE DATE.] 
  1.25     Section 1 is effective August 1, 1998, and applies to 
  2.1   offenses committed on or after that date.
