  1.1                          A bill for an act 
  1.2             relating to health; providing for disenrollment from 
  1.3             MinnesotaCare based on income; amending Minnesota 
  1.4             Statutes 1997 Supplement, section 256L.07, subdivision 
  1.5             1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.8   256L.07, subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [GENERAL REQUIREMENTS.] Families and 
  1.10  individuals who enroll on or after October 1, 1992, are eligible 
  1.11  for subsidized premium payments based on a sliding scale under 
  1.12  section 256L.08 only if the family or individual meets the 
  1.13  requirements in subdivisions 2 and 3.  Children already enrolled 
  1.14  in the children's health plan as of September 30, 1992, eligible 
  1.15  under section 256L.04, subdivision 1, paragraph (a), children 
  1.16  who enroll in the MinnesotaCare program after September 30, 
  1.17  1992, pursuant to Laws 1992, chapter 549, article 4, section 17, 
  1.18  and children who enroll under section 256L.04, subdivision 6, 
  1.19  are eligible for subsidized premium payments without meeting 
  1.20  these requirements, as long as they maintain continuous coverage 
  1.21  in the MinnesotaCare plan or medical assistance.  
  1.22     Families and individuals who initially enrolled in 
  1.23  MinnesotaCare under section 256L.04 or 256L.13, and whose income 
  1.24  increases above the limits established in section sections 
  1.25  256L.08 and 256L.13, may continue enrollment and pay the full 
  2.1   cost of coverage are no longer eligible for the program and 
  2.2   shall be disenrolled by the commissioner.  MinnesotaCare 
  2.3   coverage terminates the last day of the calendar month following 
  2.4   the month in which the commissioner determines that the income 
  2.5   of a family or individual, as determined under section 256L.08, 
  2.6   exceeds program income limits.
