1.1 A bill for an act 1.2 relating to landlord tenant; requiring expungement of 1.3 court eviction records after one year; amending 1.4 Minnesota Statutes 2002, section 504B.241, subdivision 1.5 4. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2002, section 504B.241, 1.8 subdivision 4, is amended to read: 1.9 Subd. 4. [COURT FILE INFORMATION.] (a) Court records of an 1.10 eviction action must be expunged one year after the action is 1.11 commenced. 1.12 (b) If a residential tenant screening service includes 1.13 information from a court file on an individual in a residential 1.14 tenant report, the report must provide the full name and date of 1.15 birth of the individual in any case where the court file 1.16 includes the individual's full name and date of birth, and the 1.17 outcome of the court proceeding must be accurately recorded in 1.18 the residential tenant report including the specific basis of 1.19 the court's decision, when available.If a tenant screening1.20service knows that a court file has been expunged, theA tenant 1.21 screening service shall delete any reference tothata court 1.22 eviction file in any data maintained or disseminated by the 1.23 screening service one year after the eviction action was 1.24 commenced. Whenever the court supplies information from a court 1.25 file on an individual, in whatever form, the court shall include 2.1 the full name and date of birth of the individual, if that is 2.2 indicated on the court file or summary, and information on the 2.3 outcome of the court proceeding, including the specific basis of 2.4 the court's decision, coded as provided in subdivision 5 for the 2.5 type of action, when it becomes available. The residential 2.6 tenant screening service is not liable under section 504B.245 if 2.7 the residential tenant screening service reports complete and 2.8 accurate information as provided by the court.
