  1.1                          A bill for an act 
  1.2             relating to crime; requiring suspension of a driver's 
  1.3             license for a person charged with fleeing a peace 
  1.4             officer in a motor vehicle; requiring revocation after 
  1.5             conviction of that offense; amending Minnesota 
  1.6             Statutes 1994, section 609.487, by adding 
  1.7             subdivisions; proposing coding for new law in 
  1.8             Minnesota Statutes, chapter 171. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [171.174] [SUSPENSION; FLEEING PEACE OFFICER IN 
  1.11  MOTOR VEHICLE.] 
  1.12     The commissioner of public safety shall suspend the 
  1.13  driver's license of a person charged with fleeing a peace 
  1.14  officer under section 609.487 if the court has notified the 
  1.15  commissioner under subdivision 5 of that section.  The 
  1.16  suspension shall continue until the charge is adjudicated.  A 
  1.17  limited license under section 171.30 may be issued only upon 
  1.18  recommendation of the court.  
  1.19     Sec. 2.  [171.75] [REVOCATION; FLEEING PEACE OFFICER 
  1.20  OFFENSE.] 
  1.21     The commissioner of public safety shall revoke the driver's 
  1.22  license of a person upon receipt of a certificate of conviction 
  1.23  showing that the person has in a motor vehicle violated section 
  1.24  609.487, subdivision 3 or 4, or an ordinance in conformity with 
  1.25  those subdivisions.  The commissioner shall revoke the driver's 
  1.26  license as follows: 
  1.27     (1) for the first offense under section 609.487, 
  2.1   subdivision 3, for not less than one year; 
  2.2      (2) for the second offense or subsequent offenses under 
  2.3   section 609.487, subdivision 3, for not less than three years; 
  2.4      (3) for an offense under section 609.487, subdivision 4, 
  2.5   clause (a), for not less than ten years; 
  2.6      (4) for an offense under section 609.487, subdivision 4, 
  2.7   clause (b), for not less than seven years; and 
  2.8      (5) for an offense under section 609.487, subdivision 4, 
  2.9   clause (c), for not less than five years. 
  2.10     A limited license under section 171.30 may not be issued 
  2.11  for one-half of the revocation period specified in clauses (1) 
  2.12  to (5) and after that period is over only upon and as 
  2.13  recommended by the adjudicating court. 
  2.14     Sec. 3.  Minnesota Statutes 1994, section 609.487, is 
  2.15  amended by adding a subdivision to read: 
  2.16     Subd. 5.  [SUSPENSION; FLEEING PEACE OFFICER OFFENSE.] When 
  2.17  a person is charged with operating a motor vehicle in violation 
  2.18  of subdivision 3 or 4, or any ordinance in conformity with those 
  2.19  subdivisions, the court shall notify the commissioner of public 
  2.20  safety and order the commissioner to suspend the driver's 
  2.21  license of the person for all vehicle classes. 
  2.22     Sec. 4.  Minnesota Statutes 1994, section 609.487, is 
  2.23  amended by adding a subdivision to read: 
  2.24     Subd. 6.  [REVOCATION; FLEEING PEACE OFFICER OFFENSE.] When 
  2.25  a person is convicted of operating a motor vehicle in violation 
  2.26  of subdivision 3 or 4, or an ordinance in conformity with those 
  2.27  subdivisions, the court shall notify the commissioner of public 
  2.28  safety and order the commissioner to revoke the driver's license 
  2.29  of the person. 
  2.30     Sec. 5.  [EFFECTIVE DATE.] 
  2.31     Sections 1 to 4 are effective August 1, 1996, and apply to 
  2.32  crimes committed on or after that date.
