  1.1                          A bill for an act 
  1.2             relating to Board of Water and Soil Resources; 
  1.3             allowing the governor to appoint the executive 
  1.4             director; amending Minnesota Statutes 2002, section 
  1.5             103B.101, subdivision 4.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 103B.101, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [EMPLOYEES.] The governor shall appoint an 
  1.10  executive director in the unclassified service.  The board may 
  1.11  employ an executive director in the unclassified service and 
  1.12  other permanent and temporary employees in accordance with 
  1.13  chapter 43A.  The board may prescribe the powers and duties of 
  1.14  its officers and employees, other than the executive director, 
  1.15  and may authorize its employees and members of the board to act 
  1.16  on behalf of the board.  
  1.17     Sec. 2.  [EFFECTIVE DATE.] 
  1.18     Section 1 is effective July 1, 2004.  The executive 
  1.19  director employed by the board on the effective date of section 
  1.20  1 shall retain that position until a new executive director is 
  1.21  appointed by the governor.
