  1.1                          A bill for an act 
  1.2             relating to the environment; providing for a method of 
  1.3             reducing motor vehicle emissions inspections; amending 
  1.4             Minnesota Statutes 1994, section 116.61, subdivision 
  1.5             1a, as added. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 116.61, 
  1.8   subdivision 1a, as added by Laws 1995, chapter 204, section 2, 
  1.9   is amended to read: 
  1.10     Subd. 1a.  [EXCEPTION FOR NEW VEHICLES.] (a) A vehicle need 
  1.11  not be inspected until the year in which it is being registered 
  1.12  is five years more than its model year.  The five-year exception 
  1.13  remains in effect until the agency adjusts it under paragraph 
  1.14  (c). 
  1.15     (b) By March 1 of each year beginning in 1997, the agency 
  1.16  shall determine by model year the percentage of motor vehicles 
  1.17  that failed emissions testing in the previous year.  
  1.18     (c) When fewer than one percent of vehicles of a given 
  1.19  model year fail emissions testing, the agency shall, by July 1 
  1.20  of the following year, permanently increase the exception in 
  1.21  paragraph (a) by one year for each model year that failed at 
  1.22  less than one percent. 
  1.23     (d) The determination in paragraph (b) shall exclude model 
  1.24  years that failed at less than one percent in the previous year, 
  1.25  resulting in an adjustment under paragraph (c).
