  1.1                          A bill for an act 
  1.2             relating to animal cruelty; protection for animals in 
  1.3             certain motor vehicles; proposing coding for new law 
  1.4             in Minnesota Statutes, chapter 343.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [343.245] [ANIMAL PROTECTION.] 
  1.7      Subdivision 1.  [REQUIRED PRACTICE.] A person who 
  1.8   transports an animal on a public roadway in the cargo portion of 
  1.9   a motor vehicle must ensure that the animal is protected in a 
  1.10  manner that prevents the animal from falling, jumping, or being 
  1.11  thrown from the vehicle. 
  1.12     Subd. 2.  [COMPLIANCE.] A person complies with subdivision 
  1.13  1 if: 
  1.14     (1) the space is enclosed; 
  1.15     (2) the space has racks on all open sides with adequate 
  1.16  height and density to retain the animal; 
  1.17     (3) the animal is cross tethered to the vehicle; or 
  1.18     (4) the animal is transported in a cage or container 
  1.19  secured to the vehicle. 
  1.20     Subd. 3.  [EXCEPTION.] Subdivision 1 does not apply to a 
  1.21  dog being transported by a farmer as defined in section 500.24 
  1.22  or a farm employee, while the farmer or employee is engaged in 
  1.23  agricultural activities on the farm or within five miles of the 
  1.24  farm.
