  1.1                          A bill for an act 
  1.2             relating to the environment; providing liability 
  1.3             protections under the state superfund statute for a 
  1.4             voluntary cleanup by a person who is not responsible 
  1.5             for the release; amending Minnesota Statutes 2000, 
  1.6             section 115B.175, subdivision 1.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 115B.175, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [PROTECTION FROM LIABILITY; SCOPE.] (a) 
  1.11  Subject to the provisions of this section, a person who is not 
  1.12  otherwise responsible under sections 115B.01 to 115B.18 for a 
  1.13  release or threatened release will not be responsible under 
  1.14  those sections for the any release or threatened release that 
  1.15  occurs prior to the date of the investigation report under 
  1.16  subdivision 3, if the person undertakes and completes response 
  1.17  actions to remove or remedy all known releases and threatened 
  1.18  releases at an identified area of real property in accordance 
  1.19  with a voluntary response action plan approved by the 
  1.20  commissioner. 
  1.21     (b) The liability protection provided under this 
  1.22  subdivision applies to releases or threatened releases at the 
  1.23  identified property that are not required to be removed or 
  1.24  remedied by the approved voluntary response action plan if the 
  1.25  requirements of subdivision 2 are met.
