  1.1                          A bill for an act 
  1.2             relating to environment; adding methane gas recovery 
  1.3             to the list of preferred waste management practices; 
  1.4             amending Minnesota Statutes 1998, section 115A.02. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 115A.02, is 
  1.7   amended to read: 
  1.8      115A.02 [LEGISLATIVE DECLARATION OF POLICY; PURPOSES.] 
  1.9      (a) It is the goal of this chapter to protect the state's 
  1.10  land, air, water, and other natural resources and the public 
  1.11  health by improving waste management in the state to serve the 
  1.12  following purposes:  
  1.13     (1) reduction in the amount and toxicity of waste 
  1.14  generated; 
  1.15     (2) separation and recovery of materials and energy from 
  1.16  waste; 
  1.17     (3) reduction in indiscriminate dependence on disposal of 
  1.18  waste; 
  1.19     (4) coordination of solid waste management among political 
  1.20  subdivisions; and 
  1.21     (5) orderly and deliberate development and financial 
  1.22  security of waste facilities including disposal facilities. 
  1.23     (b) The waste management goal of the state is to foster an 
  1.24  integrated waste management system in a manner appropriate to 
  1.25  the characteristics of the waste stream and thereby protect the 
  2.1   state's land, air, water, and other natural resources and the 
  2.2   public health.  The following waste management practices are in 
  2.3   order of preference: 
  2.4      (1) waste reduction and reuse; 
  2.5      (2) waste recycling; 
  2.6      (3) composting of yard waste and food waste; 
  2.7      (4) resource recovery through mixed municipal solid waste 
  2.8   composting or incineration; and 
  2.9      (5) land disposal and resource recovery at municipal solid 
  2.10  waste landfills subject to Code of Federal Regulations, title 
  2.11  40, part 258, if methane gas is recovered for the production of 
  2.12  energy for use on site or for sale; and 
  2.13     (6) land disposal which does not involve the recovery of 
  2.14  methane gas at municipal solid waste landfills subject to Code 
  2.15  of Federal Regulations, title 40, part 258, for the production 
  2.16  of energy for use on site or for sale. 
  2.17     Sec. 2.  [EFFECTIVE DATE.] 
  2.18     Section 1 is effective the day following final enactment.
