1.1 A bill for an act 1.2 relating to liquor; removing limits on the number of 1.3 on-sale and off-sale liquor licenses that may be 1.4 issued by a municipality; amending Minnesota Statutes 1.5 2002, section 340A.601, subdivision 5; repealing 1.6 Minnesota Statutes 2002, section 340A.413. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 2002, section 340A.601, 1.9 subdivision 5, is amended to read: 1.10 Subd. 5. [ISSUANCE OF LICENSES TO PRIVATE PERSONS.] A city 1.11 owning and operating a municipal liquor store may issue on-sale 1.12 liquor licenses to hotels, clubs, and restaurants. A city 1.13 issuing on-sale licenses under this subdivision may continue to 1.14 operate the municipal liquor store or may resume operation of a 1.15 municipal liquor store previously discontinued. 1.16The number of on-sale licenses issued under this section by1.17a city is governed by section 340A.413.1.18 A city may not issue licenses under this section, other 1.19 than a license issued to a club under section 340A.404, 1.20 subdivision 1, clause (4), until authorized by the voters of the 1.21 city voting on the question at a special election called for 1.22 that purpose. 1.23 Sec. 2. [REPEALER.] 1.24 Minnesota Statutes 2002, section 340A.413, is repealed. 1.25 Sec. 3. [EFFECTIVE DATE.] 1.26 Sections 1 and 2 are effective the day following final 2.1 enactment.
