  1.1                          A bill for an act 
  1.2             relating to retirement; St. Paul police and fire 
  1.3             consolidation accounts; clarifying a limitation on 
  1.4             postretirement benefit reductions; amending Laws 1992, 
  1.5             chapter 563, section 5. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 1992, chapter 563, section 5, is amended 
  1.8   to read: 
  1.9      Sec. 5.  [ST. PAUL POLICE AND FIRE CONSOLIDATION ACCOUNTS; 
  1.10  LIMITATION ON POSTRETIREMENT BENEFIT REDUCTIONS.] 
  1.11     (a) A monthly service pension or retirement benefit payment 
  1.12  from the St. Paul fire department relief association 
  1.13  consolidation account or the St. Paul police relief association 
  1.14  consolidation account may not be reduced in amount to an amount 
  1.15  that is less than that received by the person for the 
  1.16  immediately previous month. 
  1.17     (b) The service pension or retirement benefit payable from 
  1.18  the St. Paul fire department consolidation account or from the 
  1.19  St. Paul police consolidation account to a person who becomes 
  1.20  newly entitled to that service pension or retirement benefit may 
  1.21  not be an amount that is less than the service pension or 
  1.22  retirement benefit then payable to a comparably situated 
  1.23  pensioner or benefit recipient of that consolidation account. 
  1.24     This (c) The limitation in paragraph (a) or (b) may not be 
  1.25  construed to limit the power of the board of trustees of the 
  2.1   relief association to require proof of continuing eligibility 
  2.2   for receipt of a disability benefit or a survivor benefit, or to 
  2.3   require the reduction in amount or elimination of a disability 
  2.4   benefit in the event of changed medical circumstances, or to 
  2.5   require the reduction in amount or elimination of a survivor 
  2.6   benefit in the event of changes in eligibility. 
  2.7      Sec. 2.  [EFFECTIVE DATE.] 
  2.8      Section 1 is effective retroactively to December 31, 1993, 
  2.9   upon approval by the city council of the city of St. Paul and 
  2.10  compliance with Minnesota Statutes, section 645.021.
