  1.1                             A resolution
  1.2             memorializing the United States Senators of the State 
  1.3             of Minnesota to support the President's nominees to 
  1.4             the United States Supreme Court. 
  1.5      
  1.6      WHEREAS, Article II, Section 2 of the United States 
  1.7   Constitution states the President "shall nominate, and by and 
  1.8   with the advice and consent of the senate shall appoint 
  1.9   ambassadors, other public ministers and consuls, judges of the 
  1.10  supreme court, and all other officers of the United States"; and 
  1.11     WHEREAS, there is a high likelihood of at least one vacancy 
  1.12  on the United States Supreme Court during the 109th Congress; 
  1.13  and 
  1.14     WHEREAS, there is a possibility of the need to elevate a 
  1.15  sitting justice on the United States Supreme Court to the 
  1.16  position of Chief Justice during the 109th Congress; and 
  1.17     WHEREAS, activist judges on some federal courts have 
  1.18  frustrated the constitutional structure which prescribes that 
  1.19  laws shall be written by elected legislatures; and 
  1.20     WHEREAS, President George W. Bush has expressed his 
  1.21  commitment to appoint federal judges who will strictly interpret 
  1.22  the United States Constitution; and 
  1.23     WHEREAS, in the past, a minority of Senators has used 
  1.24  dilatory tactics to prevent a Senate floor vote on several of 
  1.25  George W. Bush's judicial nominees, all of whom were reported 
  2.1   favorably by the United States Senate Committee on the 
  2.2   Judiciary; NOW, THEREFORE, 
  2.3      BE IT RESOLVED by the Legislature of the State of Minnesota 
  2.4   that it requests that our United States Senators move quickly to 
  2.5   confirm all nominations by President George W. Bush to the 
  2.6   United States Supreme Court. 
  2.7      BE IT FURTHER RESOLVED that the Secretary of State of the 
  2.8   State of Minnesota is directed to prepare copies of this 
  2.9   memorial and transmit them to the President and the Secretary of 
  2.10  the United States Senate and Minnesota's Senators in Congress.
