  1.1                          A bill for an act 
  1.2             relating to public contracting; prohibiting school 
  1.3             boards from requiring adherence to certain labor 
  1.4             agreements; amending Minnesota Statutes 2002, section 
  1.5             123B.52, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 123B.52, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 1a.  [CONSTRUCTION CONTRACTS.] In entering into a 
  1.10  contract for, or in calling for bids for, the construction or 
  1.11  repair of a facility, a board may not require that any 
  1.12  contractor or subcontractor that is not signatory to an 
  1.13  agreement with a labor organization at the time it makes a bid 
  1.14  or is awarded a contract, do any of the following as a condition 
  1.15  of performing work on the construction or repair project: 
  1.16     (1) enter into or agree to adhere to or otherwise observe 
  1.17  the wage, benefit, or economic terms of, or incur any economic 
  1.18  detriment pursuant to, any agreement with any labor organization 
  1.19  in connection with the public improvement; or 
  1.20     (2) enter into any agreement that requires the employees of 
  1.21  that contractor or subcontractor to do either of the following 
  1.22  as a condition of employment or continued employment: 
  1.23     (i) become members of or become affiliated with a labor 
  1.24  organization; or 
  1.25     (ii) pay dues or fees to a labor organization.
