  1.1                          A bill for an act 
  1.2             relating to public employees; modifying the definition 
  1.3             of essential employee; amending Minnesota Statutes 
  1.4             2002, section 179A.03, subdivision 7. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 179A.03, 
  1.7   subdivision 7, is amended to read: 
  1.8      Subd. 7.  [ESSENTIAL EMPLOYEE.] "Essential employee" means 
  1.9   firefighters,; peace officers subject to licensure under 
  1.10  sections 626.84 to 626.863,; 911 system and police and fire 
  1.11  department public safety dispatchers,; guards at correctional 
  1.12  facilities,; confidential employees,; supervisory 
  1.13  employees,; assistant county attorneys,; assistant city 
  1.14  attorneys,; principals, and assistant principals; and operating 
  1.15  engineers, electrical workers, pipefitters, and machinists 
  1.16  employed by the metropolitan council to repair, maintain, or 
  1.17  operate the metropolitan disposal system as defined in section 
  1.18  473.121, subdivision 24.  However, for state employees, 
  1.19  "essential employee" means all employees in law enforcement, 
  1.20  health care professionals, correctional guards, professional 
  1.21  engineering, and supervisory collective bargaining units, 
  1.22  irrespective of severance, and no other employees.  For 
  1.23  University of Minnesota employees, "essential employee" means 
  1.24  all employees in law enforcement, nursing professional and 
  1.25  supervisory units, irrespective of severance, and no other 
  2.1   employees.  "Firefighters" means salaried employees of a fire 
  2.2   department whose duties include, directly or indirectly, 
  2.3   controlling, extinguishing, preventing, detecting, or 
  2.4   investigating fires.  Employees for whom the state court 
  2.5   administrator is the negotiating employer are not essential 
  2.6   employees. 
  2.7      Sec. 2.  [EFFECTIVE DATE.] 
  2.8      This act is effective the day following final enactment.
