A bill for an act
relating to education finance; creating a mechanism to
allow compensatory revenue amounts to follow the
student to a nonresident school district;
appropriating money; amending Minnesota Statutes 2004,
section 126C.10, subdivision 4, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 126C.10, is
amended by adding a subdivision to read:

new text begin Enrollment options compensatory revenue.new text end

nonresident pupil's enrollment options compensatory revenue
equals the greater of zero, or the difference between the
average compensatory revenue per adjusted marginal cost pupil
unit in the pupil's resident school district and the pupil's
serving school district for that school year. A school
district's enrollment options compensatory revenue equals the
sum of its nonresident pupils' enrollment options compensatory
revenue.

Sec. 2.

Minnesota Statutes 2004, section 126C.10,
subdivision 4, is amended to read:


Subd. 4.

Basic skills revenue.

A school district's basic
skills revenue equals the sum of:

(1) compensatory revenue under deleted text begin subdivision deleted text end new text begin subdivisions new text end 3
new text begin and 3anew text end ; plus

(2) limited English proficiency revenue under section
124D.65, subdivision 5; plus

(3) $250 times the limited English proficiency pupil units
under section 126C.05, subdivision 17.
