  1.1                          A bill for an act 
  1.2             relating to motor vehicles; prohibiting persons from 
  1.3             installing certain windows and window treatments on 
  1.4             motor vehicles; amending Minnesota Statutes 2002, 
  1.5             section 169.71, subdivision 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 169.71, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [GLAZING MATERIAL; PROHIBITIONS AND EXCEPTIONS.] 
  1.10  (a) No person shall drive or operate any motor vehicle required 
  1.11  to be registered in the state of Minnesota upon any street or 
  1.12  highway under the following conditions:  
  1.13     (1) when the windshield is composed of, covered by, or 
  1.14  treated with any material which has the effect of making the 
  1.15  windshield more reflective or in any other way reducing light 
  1.16  transmittance through the windshield; 
  1.17     (2) when any window on the vehicle is composed of, covered 
  1.18  by, or treated with any material that has a highly reflective or 
  1.19  mirrored appearance; 
  1.20     (3) when any side window or rear window is composed of or 
  1.21  treated with any material so as to obstruct or substantially 
  1.22  reduce the driver's clear view through the window or has a light 
  1.23  transmittance of less than 50 percent plus or minus three 
  1.24  percent in the visible light range or a luminous reflectance of 
  1.25  more than 20 percent plus or minus three percent; or 
  2.1      (4) when any material has been applied after August 1, 
  2.2   1985, to any motor vehicle window without an accompanying 
  2.3   permanent marking which indicates the percent of transmittance 
  2.4   and the percent of reflectance afforded by the material.  The 
  2.5   marking must be in a manner so as not to obscure vision and be 
  2.6   readable when installed on the vehicle.  
  2.7      (b) This subdivision does not apply to glazing materials 
  2.8   which: 
  2.9      (1) have not been modified since the original installation, 
  2.10  nor to original replacement windows and windshields, that were 
  2.11  originally installed or replaced in conformance with Federal 
  2.12  Motor Vehicle Safety Standard 205; 
  2.13     (2) are required to satisfy prescription or medical needs 
  2.14  of the driver of the vehicle or a passenger if the driver or 
  2.15  passenger is in possession of the prescription or a physician's 
  2.16  statement of medical need; or 
  2.17     (3) are applied to: 
  2.18     (i) the rear windows of a pickup truck as defined in 
  2.19  section 168.011, subdivision 29; 
  2.20     (ii) the rear windows or the side windows on either side 
  2.21  behind the driver's seat of a van as defined in section 168.011, 
  2.22  subdivision 28; 
  2.23     (iii) the side and rear windows of a vehicle used to 
  2.24  transport human remains by a funeral establishment holding a 
  2.25  license under section 149A.50; or 
  2.26     (iv) the side and rear windows of a limousine as defined in 
  2.27  section 168.011, subdivision 35. 
  2.28     (c) No person may: 
  2.29     (1) permanently apply to the side or rear window of a motor 
  2.30  vehicle belonging to another any material that would result in 
  2.31  the motor vehicle being in violation of paragraph (a), clause 
  2.32  (2) or (3); or 
  2.33     (2) install a side or rear window of a motor vehicle 
  2.34  belonging to another that would result in the motor vehicle 
  2.35  being in violation of paragraph (a), clause (2) or (3). 
  2.36  Violation of this paragraph is a misdemeanor.
