  1.1                          A bill for an act 
  1.2             relating to education finance; authorizing one-time 
  1.3             excess fuel cost adjustment and energy assistance aid 
  1.4             to school districts; appropriating money. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [EXCESS FUEL COST ADJUSTMENT.] 
  1.7      (a) For fiscal year 2002 only, excess fuel costs are all 
  1.8   fuel costs above an annual average of $1.129 per gallon, 
  1.9   including all applicable taxes.  The department of children, 
  1.10  families, and learning must reimburse each school district for 
  1.11  all excess fuel costs. 
  1.12     (b) The annual average cost of fuel is equal to: 
  1.13     (1) the total fuel costs of a district for the previous 
  1.14  school year; divided by 
  1.15     (2) the total number of gallons consumed by the district in 
  1.16  the previous year. 
  1.17     [EFFECTIVE DATE.] This section is effective the day 
  1.18  following final enactment. 
  1.19     Sec. 2.  [ENERGY ASSISTANCE AID.] 
  1.20     For fiscal year 2002 only, a school district is eligible 
  1.21  for energy assistance aid for school facilities heating costs 
  1.22  equal to $25 times the district's adjusted marginal cost pupil 
  1.23  units for that year. 
  1.24     [EFFECTIVE DATE.] This section is effective the day 
  1.25  following final enactment. 
  2.1      Sec. 3.  [APPROPRIATION.] 
  2.2      $....... is appropriated in fiscal year 2002 from the 
  2.3   general fund to the commissioner of children, families, and 
  2.4   learning for the payment of excess fuel cost adjustment and 
  2.5   energy assistance to school districts. 
  2.6      [EFFECTIVE DATE.] This section is effective the day 
  2.7   following final enactment.
