  1.1                          A bill for an act
  1.2             relating to crime; increasing penalties for fleeing a 
  1.3             peace officer in a motor vehicle; amending Minnesota 
  1.4             Statutes 1996, section 609.487, subdivisions 3 and 4. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 609.487, 
  1.7   subdivision 3, is amended to read: 
  1.8      Subd. 3.  [FLEEING AN OFFICER.] Whoever by means of a motor 
  1.9   vehicle flees or attempts to flee a peace officer who is acting 
  1.10  in the lawful discharge of an official duty, and the perpetrator 
  1.11  knows or should reasonably know the same to be a peace 
  1.12  officer, may be sentenced to imprisonment for not more than one 
  1.13  year or to payment of a fine of not more than $3,000, or both.  
  1.14  Whoever violates this subdivision a second or subsequent time is 
  1.15  guilty of a felony and may be sentenced to imprisonment for not 
  1.16  more than one year and one day or to payment of a fine of not 
  1.17  more than $3,000, or both. 
  1.18     Sec. 2.  Minnesota Statutes 1996, section 609.487, 
  1.19  subdivision 4, is amended to read: 
  1.20     Subd. 4.  [FLEEING AN OFFICER; DEATH; BODILY INJURY; 
  1.21  PROPERTY DAMAGE.] Whoever flees or attempts to flee by means of 
  1.22  a motor vehicle a peace officer who is acting in the lawful 
  1.23  discharge of an official duty, and the perpetrator knows or 
  1.24  should reasonably know the same to be a peace officer, and who 
  1.25  in the course of fleeing, in the course of committing an offense 
  2.1   described in subdivision 3, causes the death of a human being 
  2.2   not constituting murder or manslaughter or, any bodily injury to 
  2.3   any person other than the perpetrator, or any property damage, 
  2.4   may be sentenced to imprisonment as follows: 
  2.5      (a) (1) if the course of fleeing conduct results in death, 
  2.6   to imprisonment for not more than ten years or to payment of a 
  2.7   fine of not more than $20,000, or both; or 
  2.8      (b) (2) if the course of fleeing conduct results in great 
  2.9   bodily harm, to imprisonment for not more than seven years or to 
  2.10  payment of a fine of not more than $14,000, or both; or 
  2.11     (c) (3) if the course of fleeing conduct results in 
  2.12  substantial bodily harm, to imprisonment for not more than five 
  2.13  years or to payment of a fine of not more than $10,000, or both; 
  2.14  or 
  2.15     (4) if the conduct results in property damage, to 
  2.16  imprisonment for not more than three years or to payment of a 
  2.17  fine of not more than $5,000, or both.  
  2.18     Sec. 3.  [EFFECTIVE DATE.] 
  2.19     Sections 1 and 2 are effective August 1, 1997, and apply to 
  2.20  crimes committed on or after that date.
