  1.1                          A bill for an act
  1.2             relating to public safety; requiring explosive 
  1.3             materials to contain identification and detection 
  1.4             taggants; imposing criminal penalty; amending 
  1.5             Minnesota Statutes 1996, section 299F.72, by adding 
  1.6             subdivisions; proposing coding for new law in 
  1.7             Minnesota Statutes, chapter 299F. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 299F.72, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 5.  [IDENTIFICATION TAGGANT.] "Identification taggant"
  1.12  means any substance that: 
  1.13     (1) is added to an explosive material during the 
  1.14  manufacture of the material; and 
  1.15     (2) after detonation, is retrievable and permits the 
  1.16  identification of the manufacturer and the date of manufacture 
  1.17  of the material. 
  1.18     Sec. 2.  Minnesota Statutes 1996, section 299F.72, is 
  1.19  amended by adding a subdivision to read: 
  1.20     Subd. 6.  [DETECTION TAGGANT.] "Detection taggant" means 
  1.21  any substance that: 
  1.22     (1) is added to an explosive material during the 
  1.23  manufacture of the material; and 
  1.24     (2) permits the detection of the material before its 
  1.25  detonation. 
  1.26     Sec. 3.  [299F.783] [IDENTIFICATION AND DETECTION 
  2.1   TAGGANTS.] 
  2.2      Whoever knowingly manufactures, imports, transports, ships, 
  2.3   distributes, or receives, or causes to be manufactured, 
  2.4   imported, transported, shipped, distributed, or received, any 
  2.5   explosive material that does not contain an identification 
  2.6   taggant and a detection taggant is guilty of a felony and may be 
  2.7   sentenced to imprisonment for not more than ten years or payment 
  2.8   of a fine of not more than $20,000, or both. 
  2.9      Sec. 4.  [EFFECTIVE DATE.] 
  2.10     Sections 1 to 3 are effective August 1, 1997, and apply to 
  2.11  offenses committed on or after that date.
