Requiring the commissioner of human services to establish and administer the
prescription drug discount program, authorizing a contract with a pharmacy
benefit manager for administration purposes; specifying applicant eligibility
and application requirements, providing for commissioner issuance of drug
purchase identification cards to eligible individuals; requiring drug
manufacturers to provide rebates equal to the rebate provided under the medical
assistance (MA) program for prescription drugs sold or distributed in the state
and purchased by eligible individuals at participating pharmacies, specifying
certain duties of the pharmacies relating to sale of prescription drugs to
eligible individuals at a discounted price equal to the rebate, requiring
commissioner notice to drug manufacturers of the amount of rebate owed on drugs
sold by participating pharmacies; requiring the commissioner to distribute
rebate amounts collected to participating pharmacies based on the prescription
drugs sold minus an administrative fee, authorizing the commissioner to
establish the fee to cover certain expenses, requiring deposit of fees collected
in a special account to be used for the expenses; providing for enforcement of
the provisions against drug manufacturers by the attorney general, authorizing
civil action in district court; entitling individuals enrolled in prescription
drug coverage under a health plan to program eligibility under certain no
discount or rebate agreement conditions, requiring amounts collected for
prescription drugs sold by participating pharmacies to the individuals to be
distributed to the health plan company minus the administration fee (ja)
