1E Relating to unemployment insurance

ARTICLE 1 - POLICY CHANGES EFFECTIVE
AUGUST 1, 2006 AND THEREAFTER

Modifying the definition of base period;
modifying provisions relating to determinations of coverage; providing a certain
exception to employers in the tourist or recreation industry; modifying certain
employers taxes tax rate notice provisions; eliminating protest provisions for
payment to trust fund by nonprofit organizations; modifying credit adjustments
and refund provisions; eliminating protest provisions under personal liability;
clarifying benefit account provisions; modifying certain ineligibility
provisions; modifying evidentiary hearings by unemployment law judge;
authorizing assessment by the administrative law judge of an administrative fee
under certain conditions; modifying overpayments due to fraud provisions;
modifying unemployment insurance trust fund provisions and administration
account provisions; repealing provisions relating to annual payment of small
liabilities, recreational or tourist industry employment eligibility
requirements and protests by electronic transmission

ARTICLE 2 - POLICY CHANGES
EFFECTIVE AUGUST 1, 2007 AND THEREAFTER

Modifying the date for determination of
the state average annual and average weekly wage; reducing the number of
employees employers report by electronic payment; reducing the time period for
licensee appeals of business license revocations; reducing the time period for
subcontractor and employee leasing firms appeals for liability determination
purposes; modifying provision for the repayments of overpayments; reducing the
time limit for the right of appeal; modifying deductible earnings provisions
under eligibility requirements; modifying certain appeal provisions; modifying
reciprocal unemployment benefit arrangements; modifying nonfraud overpayments
under unemployment benefit overpayments provisions; modifying administrative
penalties provisions; requiring determinations subject to an appeal to an
unemployment law judge to indicate the day of the week and the date the
determination is final and no longer subject to appeal; specifying instructions
to the revisor

ARTICLE 3 - HOUSEKEEPING PROVISIONS

Making certain
housekeeping modifications

ARTICLE 4 - ADMINISTRATIVE RULES INCORPORATED INTO
STATUTES

Incorporating long standing administrative rules into statute;
specifying instructions to the revisor; repealing certain rules

ARTICLE 5 -
TERMINOLOGY CHANGE

Substituting the term disqualify or similar terms with the
term ineligible or similar terms

ARTICLE 6 - STYLE CHANGES

Providing for
style changes to conform to preferred modern statutory drafting conventions for
the use of clear, concise and plain language
