E Relating to state procurement; codifying the provisions regulating the
competitive bidding process for state building and construction or repair
contracts; requiring standard requirement price contracts for building and
construction to be established by competitive bids, authorizing the contracts to
contain escalation clauses and to provide for negotiated price increases or
decreases and limiting the contract term; specifying certain requirements for
expenditures over and under a certain amount and certain standard specifications
and security requirements; encouraging state agencies to contract with small
targeted group businesses for contracts not subject to competitive bidding
procedures; exempting contracts limited to a single source of supply, certain
negotiated contracts and emergency purchases from the competitive bidding
process; specifying certain lowest responsible bidder contract award
requirements; providing for correction of alterations or erasures; authorizing
the commissioner of administration to reject the bids of bidders failing to
perform previous contracts with the state and authorizing the commissioner to
use negotiated procurement methods with tied low bidders under certain price
conditions; specifying certain recordkeeping requirements; contract preferences
not to be cumulative, prohibiting the total percentage of preference granted on
a contract from exceeding the highest percentage of preference allowed for the
contract; requiring the commissioner to develop procedures to audit agency
personnel delegated contracting authority to ensure compliance with laws and
guidelines governing issuance of contracts including laws and guidelines
governing conflicts of interest (ra, ja)
