Modifying certain provisions regulating medical assistance (MA) +reimbursements
to nursing facilities; modifying the payment rates for bed layaway +and
delicensure, expanding the provision to removal of beds from layaway;+ modifying
the exclusion of the raw food cost adjustment; providing for the +allocation of
long term care facility central, affiliated or corporate office costs+ on a
functional basis and modifying the required allocation of remaining +costs;
providing for the treatment of related organization costs; providing +for the
phase out of alternative payment system contracts; establishing a new+ nursing
facility reimbursement system; requiring the commissioner of human +services to
establish a value based nursing facility reimbursement system to +provide
facility specific prospective rates for facilities participating in +the medical
assistance program and providing for determination of the rates; +defining
certain terms; providing for facility reporting of statistical and +cost
information and for calculation of direct care and support services +per diem
costs, the quality score, target prices and operating costs +uninflated payment
rates; providing for certain geographic adjustments; requiring the +commissioner
to biennially provide information to the legislature specifying +certain
adjusters for operating payment rates; requiring and providing for +the
commissioner to calculate the payment rates for external fixed and +property
related costs and the total payment rate; providing for phase in of +the rate
setting methods; authorizing commissioner negotiation of operating +payment
rates for specialized care; granting the commissioner certain audit +authority;
requiring the commissioner to provide certain remedies for disputes +and to
determine interim payment rates for facilities without a cost history (mk)
