E Modifying the authority of the commissioner of human services to set aside
disqualifications of human services license applicants based on background
checks, modifying the list of disqualifying crimes; requiring the commissioner
in setting aside disqualifications to inform the license holder of the
availability of information relating to the nature of the disqualification and
the factors used in the decision to set aside the disqualification without
consent of the subject of the background study; authorizing the commissioner
with the consent of the background study subject to release to the license
holder copies of information relating to and the decision to set aside the
disqualification; requiring the commissioner to consult with the commissioners
of health and corrections, the attorney general and certain groups involved with
vulnerable adult maltreatment investigations and background studies and inform
the legislature by a certain date about issues most in need of policy review,
specifying certain review content requirements; requesting the supreme court to
study and make recommendations to the legislature by a certain date relating to
methods for tracking the filing and status of civil actions for damages
resulting from sexual abuse to identify individuals to be disqualified from
human services licensing (ra, ja)
