E Establishing requirements for the sale of funeral goods and services and
preneed funeral arrangements; defining burial site goods and burial site
services and preneed consumer and clarifying the definition of funeral provider;
authorizing the commissioner of health to prohibit certain funeral providers
from selling preneed funeral or burial site goods or services for violation,
providing for the issuance of cease and desist orders, hearing requirement upon
request; prohibiting funeral provider solicitations under certain conditions,
exception; requiring funeral establishments and providers to disclose ownership
and ownership changes and offerings or prices of cemetery specific goods and
services, defining change in ownership, requiring the disclosure of the
availability of price lists at container sale locations and the price ranges for
markers and headstones; modifying certain itemized statement signature
requirements; requiring provider provision of copies of preneed arrangement
documents to persons controlling final disposition of the remains of individuals
with preneed arrangements; specifying the charging of increased prices for the
handling of goods or services based on purchase of the goods or services from
another provider and the requiring as a condition of providing funeral or burial
site goods purchase in lieu of rental as deceptive acts or practices;
prohibiting providers from interring outer burial containers until the death of
the beneficiary; specifying certain preneed funeral arrangement agreement and
trust requirements; prohibiting finance charges on preneed arrangements;
requiring and providing for refund of consideration paid upon cancellation of
preneed arrangement agreements by purchasers; requiring the commissioner to make
recommendations to the legislature by a certain date on the need for additional
funding for ongoing implementation of the regulatory provisions with proposals
for an alternative funding source (mk, ja)
