Clarifying certain provisions relating to motor vehicle forfeiture for driving
while under the influence of alcohol or controlled substance (DWI); clarifying
the definitions of designated license revocation and owner and defining security
interest; authorizing forfeiture of encumbered or leased vehicles for knowledge
of unlawful use including knowledge of revoked driving privileges; requiring
administrative forfeiture notices to identify the prosecuting agency with
jurisdiction over the forfeiture; notice to the address shown in department of
public safety records to be sufficient notice to security interest holders;
modifying the notice form for clarity purposes; clarifying and modifying certain
provisions providing for judicial determination of forfeitures, prohibiting the
district court from referring actions to arbitration; creating a rebuttable
presumption of vehicle ownership; authorizing commissioner of public safety
rules for forms for notices of seizure and intent to forfeit and for
transferring titles of forfeited vehicles (mk)
