E Relating to crime prevention, adopting the new "Interstate Compact for Adult
Offender Supervision"ARTICLE I PURPOSEProviding for the adoption of a new
interstate compact to authorize and encourage cooperative efforts and mutual
assistance in tracking the location of criminal offenders, to provide a
framework for the promotion of public safety and to protect the rights of
victimsARTICLE II DEFINITIONS Defining certain terms used in the compact ARTICLE
III THE COMPACT COMMISSIONCreating the interstate commission for adult offender
supervision as a joint agency of the compacting states; specifying certain
responsibilities, powers and duties; commissioners to be selected and appointed
by members of a state council for interstate adult offender supervision to be
established in each state, providing for the inclusion of nonvoting members in
addition to commissioners; requiring meetings to be open to the public;
requiring the commission to establish an executive committee with the power to
act on behalf of the commission under certain conditions ARTICLE IV THE STATE
COUNCILRequiring each member state to create a state council for interstate
adult offender supervision to be responsible for the appointment of commission
members, specifying certain membership representation requirements and duties
ARTICLE V POWERS AND DUTIES OF THE INTERSTATE COMMISSIONGranting the interstate
commission certain powers including the oversight, supervision and coordination
of the interstate movement of offenders, to enforce compliance with the compact,
to establish and appoint committees and hire staff, to provide for dispute
resolution among compacting states and to establish uniform standards for the
reporting, collecting and exchanging of data ARTICLE VI ORGANIZATION OF THE
INTERSTATE COMMISSIONRequiring and providing for the interstate commission to
adopt bylaws, to elect certain officers and to appoint certain staff, requiring
appointment of an executive director; specifying certain records maintenance
requirements; granting commission members, officers and employees immunity from
suit and liability ARTICLE VII ACTIVITIES OF THE INTERSTATE COMMISSIONSpecifying
certain duties of the interstate commission; providing for the inspection and
copying of records; authorizing closed meetings under certain conditions;
requiring and providing for the collection of certain data on the interstate
movement of offenders ARTICLE VIII RULEMAKING FUNCTIONS OF THE INTERSTATE
COMMISSIONRequiring and providing for the adoption of rules for administration
of the compact ARTICLE IX OVERSIGHT, ENFORCEMENT AND DISPUTE RESOLUTION BY THE
INTERSTATE COMMISSIONRequiring the interstate commission to oversee the
interstate movement of adult offenders in the compacting states and to monitor
activities administered in noncompacting states significantly affecting
compacting states; imposing certain enforcement duties on the commission;
providing for the resolution of disputes arising among compacting and
noncompacting states by the commission ARTICLE X FINANCERequiring the interstate
commission to pay for certain expenses, requiring collection of an annual
assessment from each compacting state to cover the cost of the internal
operations and activities of the commission, limit; specifying certain
accounting and audit requirements; establishing the interstate compact for adult
offender supervision fund in the department of corrections ARTICLE XI COMPACTING
STATES, EFFECTIVE DATE AND AMENDMENTProviding for the effectiveness of and
amendments to the compact ARTICLE XII WITHDRAWAL, DEFAULT, TERMINATION AND
JUDICIAL ENFORCEMENTProviding for withdrawal from the compact; specifying
grounds for default and authorizing the commission to impose certain penalties;
authorizing certain legal actions; providing for dissolution of the compact
ARTICLE XIII - SEVERABILITY AND CONSTRUCTIONProviding for severability and
liberal construction of the compactARTICLE XIV BINDING EFFECT OF COMPACT AND
OTHER LAWSProviding for the conflict of laws and for the binding effect of the
compact; creating a permanent advisory council on interstate adult offender
supervision and specifying membership requirements and duties; requiring the
commissioner of corrections to serve as the compact administrator, to serve on
the advisory council and to assess and collect certain fines, fees and costs;
providing for the application of the interstate compact; imposing penalties for
violation of the provisions of the compact; appropriating money to the
commissioner for compact administration purposes; repealing the existing
interstate compact for the supervision of parolees and probationers (ra, ja)
