Relating to public safety; establishing procedures to secure blood testing of
individuals with bodily fluids coming in contact with peace officers,
authorizing peace officers and law enforcement agencies to request hospitals or
emergency medical care facilities to follow the procedures for peace officers
possibly experiencing significant exposure to source individuals; requiring the
facilities to follow the procedures under certain specified conditions and
providing for location of source individuals; requiring information relating to
confidentiality to be given to source individuals before seeking consent and to
peace officers before disclosure of information; providing for disclosure of
positive bloodborne pathogen test results and providing general procedures for
the obtaining of consent; prescribing procedures for the collection and testing
of blood samples with or without consent; prohibiting medical facilities from
basing admission or care or treatment decisions on source individuals consent
requirements; restricting the use of bloodborne pathogen test results to
diagnostic and treatment need purposes, prohibiting use of the results as
evidence in criminal or civil proceedings; providing for the confidentiality of
test information and prescribing penalties for unauthorized release of
information; establishing responsibility for testing and treatment costs;
specifying certain bloodborne pathogens exposure protocol requirements for law
enforcement agencies and medical facilities; prescribing a criminal penalty for
willful violations and providing liability immunity against civil,
administrative or criminal actions for facilities, licensed physicians and
designated health care personnel relating to the disclosure of test results to
peace officers or law enforcement agencies and to the testing of blood samples
from source individuals for good faith compliance efforts
