commissioner of transportation (DOT) to allow public review of +proposed toll
facility development agreements; prohibiting private toll facility +operators
from acquiring right-of-way by donation and authorizing road +authorities to
acquire right-of-way by donation or purchase; prohibiting private +toll facility
development agreements from containing noncompete clauses or +provisions
restricting road authorities from constructing, improving or +maintaining
highways within the jurisdiction of the road authority and requiring +fair value
for private operator acquisition or use of rights-of-way; including +toll
facilities as elements of final layout for municipal consent purposes(je, ja)
