Relating to health

ARTICLE 1 - GENERAL PROVISIONS

"Minnesota Health Care Act";
defining health care plan requirements and establishing the Minnesota health
care plan to be administered by the Minnesota health care agency, defining terms
and specifying a transition; establishing the Minnesota health care
agency

ARTICLE 2 - GOVERNANCE

Providing conforming statutory changes;
establishing the position of commissioner of health care to be appointed by the
governor, prescribing duties and oversight, requiring rulemaking; requiring the
commissioner to establish a health care policy board, prescribing duties;
establishing the ombudsman office for patient advocacy for health care consumer
interests, the inspector general for the Minnesota health care plan and the
health care policy board, prescribing duties; requiring health planning regions
establishment with regional planning directors and planning boards for each
region

ARTICLE 3 - FUNDING

Establishing the fund for health care; requiring
the health care policy board to review and approve payment contracts and
compensation plans; requiring the commissioner of health care to develop a
capital management plan and regional planning directors to develop regional
capital development plans; requiring the commissioner to establish a budget for
prescription drug and medical equipment purchases; requiring the health plan
policy board to develop a premium proposal; providing for governmental payments,
other governmental programs, federal preemption and subrogation

ARTICLE 4 -
ELIGIBILITY

Providing eligibility to all state residents and specifying
treatment of visitors, retiree benefits and minors; providing a presumptive
eligibility under certain conditions

ARTICLE 5 - BENEFITS

Authorizing any
eligible individual the option to receive services under the Minnesota health
care plan, specifying covered benefits and exclusions

ARTICLE 6 - DELIVERY OF
CARE

Authorizing all licensed health care providers in the state to participate
in the Minnesota health care plan; providing for referrals; requiring the health
policy board to establish an office of health quality and planning to provide
for short and long term health needs; requiring the ombudsman for patient
advocacy to establish a grievance system for complaints; appropriating money to
the commissioner of health care
