Relating to smokingARTICLE 1 - INDOOR SMOKINGModifying certain provisions under
the clean indoor air act; removing the exclusion of private enclosed offices
from the definition of public place and generally prohibiting smoking in public
places, retaining the exception for designated smoking areas of bars and
restaurants and removing the exception for factories, warehouses and similar
workplaces; authorizing owners or lessors of multitenant buildings with common
heating, ventilating or air conditioning (HVAC) systems to designate parts of
the building served by the common system as smoke free, providing for certain
exceptions; requiring designated smoking areas to meet standards for smoke
containment to be established by the commissioner of health, specifying certain
standards requirements and options; providing for employee rights relating to
entry into smoking areas ARTICLE 2 - ADVERTISING RESTRICTIONSProhibiting the
advertising or promotion of cigarettes or tobacco within a certain distance of
school property, playgrounds or child care or youth centers, excepting the
distribution of coupons under certain conditions; requiring owner, operator or
lessee removal of noncompliant advertisements within a certain period of time;
imposing civil penalties for violationARTICLE 3 - LITTERINGDefining the deposit
of partially burned cigarettes or ash as littering in state parks and on
streets, highways, public lands or waters and private land without the consent
of the owner, penalties(ra)
