4E Relating to retirement

ARTICLE 1 - MINNESOTA STATE RETIREMENT SYSTEM
CONTRIBUTION INCREASES

Increasing employee and employer contribution rates to
the state employees retirement fund under the Minnesota state retirement system
(MSRS); establishing procedures for revising employee and employer contributions
under certain conditions; increasing employee and employer contribution rates
under the Minnesota state retirement system (MSRS) correctional employees
retirement plan; increasing employee and employer contribution rates under the
MSRS state patrol retirement fund

ARTICLE 2 - MSRS-CORRECTIONAL RETIREMENT
PLAN INCLUSIONS

Updating references to the Minnesota sex offender program and
the Minnesota extended treatment option program; expanding the membership of the
MSRS correctional plan; specifying procedures for department of corrections
review of additional MSRS correctional plan inclusions; entitling and providing
for employees with retirement coverage transferred to the correctional plan to
elect to obtain prior service credit for eligible state service performed
between certain dates with the department of corrections, requiring commissioner
of corrections certification of eligible correctional service to the
commissioner of employee relations (DOER) and the MSRS executive director;
providing for additional employee contributions and for the transfer of assets
from the general state employees retirement plan to the correctional employees
retirement plan, requiring department of corrections reimbursement to the
legislative commission on pensions and retirement (LCPR) for actuarial work
performed by the commission actuary and providing for the effect of the asset
transfers; authorizing and providing for transfer of prior service credit from
the general plan to the correctional plan of the Minnesota state retirement
system (MSRS) by a certain individual formerly employed as a correction program
director and currently employed as a corrections lieutenant

ARTICLE 3 -
RETIREMENT PLAN ADMINISTRATIVE PROVISIONS

Modifying certain Minnesota state
colleges and universities system tax sheltered annuity minimum vendor
requirements; modifying MSRS provisions relating to the temporary reemployment
benefit reduction waiver and bounce back annuity for disabled annuitants;
including certain physicians under the definition of included public employees
for coverage purposes and clarifying eligibility for optional coverage of St.
Paul port authority employees; modifying the definitions of termination of
public service and termination of membership; expanding the definition of
authorized temporary layoff to authorized seasonal layoff and defining
indefinite layoff; clarifying certain PERA board of trustees membership
provisions and certain election procedures and specifying the legal authority of
the board; modifying certain receipts, disbursements and collection provisions
for federal requirements consistency purposes; clarifying certain disability and
bounce back annuity provisions, requiring certain disabilitant earnings reports;
eliminating the five year term certain survivor coverage option and the
authority of privately operated ambulance services to contribute to the PERA
defined contribution plan; authorizing counties to certify positions for
inclusion in local government correctional service retirement plan as
sufficiently similar to existing positions; modifying city managers and
volunteer firefighters election to PERA provisions; expanding the definition of
county correctional institution to juvenile correctional facilities administered
by a county or on behalf of multiple counties; making permanent a temporary
disabilitant trial work period provision; equalizing member and employer
contributions under the state arts board and Minnesota humanities commission IRA
plan with the MnSCU IRA plan; providing for annuity and disability treatment for
wrongful discharge; requiring appointing authorities in the executive and
legislative branches, the board of public defense, the Minnesota historical
society, and the Minnesota state colleges and universities (MnSCU) to offer
early retirement incentives to certain employees, specifying requirements;
providing prior service credit purchase for Illinois municipal retirement plan
covered service under certain conditions; providing for a temporary transfer of
certain deferred compensation contributions for voluntary or emergency on call
firefighters; repealing a certain obsolete higher education mandatory retirement
age provision

ARTICLE 4 - PERA-P & F RETIREMENT PLAN CHANGES

Modifying
disability benefits eligibility requirements under the public employees police
and fire plan of the public employees retirement association (PERA)

ARTICLE 5
- PRIVATIZATION RETIREMENT COVERAGE CHANGE

Expanding privatized public hospital
pension benefits under the public employees retirement association (PERA) to
employees of the Clearwater county memorial hospital, employees of the Dassel
lakeside community home and employees of the city of Cannon Falls hospital;
requiring the city of Hutchinson to file a certificate of approval by a certain
date relating to the Hutchinson area health care center privatized public
hospital pension benefits under the public employees retirement association
(PERA; removing the Hutchinson area health care center and the Northfield
hospital from legislative commission on pensions and retirement actuarial
oversight; modifying augmentation interest rates provided to privatized
employees for medical facility or other public employing unit privatizations
effective after a certain date under the public employees retirement association
(PERA)

ARTICLE 6 - SOCIAL SECURITY COVERAGE CHANGES

Providing for prospective
and retroactive social security and medicare coverage of certain public
employees, specifying certain referendum requirements

ARTICLE 7 - SUPPLEMENTAL
RETIREMENT PLAN COVERAGE CHANGES

Increasing the limit on employer contributions
to the laborers national industrial and plumbers and pipefitters national and
local pensions funds under the public employees retirement association (PERA)
and expanding the exceptions to the prohibition on public fund contributions to
supplemental pension or deferred compensation plans to laborers local pension
funds and the international association of machinists

ARTICLE 8 - RETIREMENT
FUND INVESTMENT AUTHORITY CHANGES

Modifying reporting requirements of certain
pension plans relating to investment and portfolio market value; expanding
authorized investments in securities to real estate trusts and insurance company
commingled accounts, removing the investments from the other investments
category; increasing the aggregate value ceiling of certain additional
investments; repealing certain statement of economic interest filing and
investment disclosure requirements

ARTICLE 9 - MINNEAPOLIS POLICE RELIEF
ASSOCIATION CHANGES

Authorizing an increase in board members salaries and
increasing benefits to persons serving less than 20 years; prohibiting
disability benefit recomputation of service related injuries or diseases by the
Minneapolis police relief association board of directors, requiring prior
recomputations of service related injuries to be revoked under certain
conditions

ARTICLE 10 - RECODIFICATION OF VARIOUS STATEWIDE SPECIALTY
RETIREMENT PLANS

Modifying and recodifying certain provisions under the
legislators retirement plan of the Minnesota state retirement system (MSRS);
defining or redefining certain terms; clarifying administrative responsibility;
modifying certain retirement allowance qualification, deferred annuities and
survivor benefit provisions and clarifying certain provisions relating to the
reduced retirement allowance, optional annuities, contributions, the
irrevocability of certain elections, service credit, coverage by more than one
retirement system or association and exemption from process and taxation;
repealing certain definitions and certain provisions relating to retirement
allowance payment for past service, survivor benefits and membership in the
public employees retirement association (PERA); applying certain provisions of
the elective state officers retirement plan under MSRS to a certain former
constitutional officer and clarifying the administrative agency and standards of
the plan; making certain technical corrections; repealing certain obsolete
provisions

ARTICLE 11 - JUDGES RETIREMENT PLAN AND BOARD ON JUDICIAL STANDARDS
RECODIFICATION

Clarifying and revising certain provisions under the judges
retirement plan of the Minnesota state retirement system (MSRS) relating to
administration of the fund, fiduciary responsibility, the judges retirement
fund, member and employer contributions, annuities and benefits, part time
service and compulsory retirement; defining or redefining certain terms;
recodifying and revising certain provisions governing the board on judicial
standards; repealing certain obsolete provisions

ARTICLE 12 - JUDGES RETIREMENT
PLAN AND RELATED CHANGES

Providing a joint and survivor annuity option to
surviving spouses of deceased judges under the judges retirement plan
administered by the Minnesota state retirement system (MSRS)

ARTICLE 13 -
VOLUNTEER FIRE RELIEF ASSOCIATION CHANGES

Modifying state auditor reporting
requirements; defining volunteer firefighters; authorizing an individual
retirement account transfer for volunteer firefighting relief association
death/survivor benefits; authorizing the payment of certain volunteer
firefighter relief association death benefits to estates; increasing the state
supplemental benefit for certain survivors; increasing the survivor benefit for
the spouse of a certain deceased member of the Randall firemen's relief
association killed in a construction accident

ARTICLE 14 - ONE PERSON AND
SMALL GROUP RETIREMENT PROVISIONS

Providing an annuity under the public
employees police and fire plan of the public employees retirement association
(PERA) for a certain former St. Paul firefighter incorrectly placed in the St.
Paul fire department relief association retirement plan to correct the coverage
error; specifying certain eligible firefighter application requirements and
providing for the calculation of the additional employee contribution or refund
amount and of the required reserves, requiring payment of the reserve amount to
the city of St. Paul for transmission to the former firefighter; authorizing and
providing for the purchase of prior service credit in the public employees
police and fire plan of the public employees retirement association (PERA) by a
certain current member of the plan formerly employed as a firefighter by the
city of Faribault; authorizing and providing for the purchase of prior service
credit in the teachers retirement association (TRA) by a certain member employed
at the Northfield middle school in independent school district #659, Northfield
for prior teaching service in Montana; authorizing and providing for the
purchase of prior service credit in the general plan of the public employees
retirement association (PERA) by a certain member of the general plan of the
Minnesota state retirement system (MSRS) for former service as a public defender
in the tenth judicial district and in Washington county; authorizing and
providing for the purchase of prior service credit in the public employees
police and fire plan for a former employee of the Minnetonka police department
granted a leave of absence to serve as a business agent for an employee labor
organization; authorizing and providing for the purchase of prior service credit
in the public employees retirement association (PERA) by a certain former
employee of the city of Anoka at the Greenhaven golf course; authorizing and
providing for the repayment of a refund to the teachers retirement association
(TRA) of contribution amounts previously transferred to the unclassified state
employees retirement program (MSRS) for a certain teacher formerly employed by
independent school district #191, Burnsville and currently employed by
independent school district #196, Rosemount-Apple Valley; authorizing and
providing for the purchase of prior service and salary credit in the teachers
retirement association by a certain person with prior employment covered by the
public employees retirement association (PERA) and currently employed by north
Hennepin community college with coverage under the higher education individual
retirement account plan and not receiving an offer of election of TRA coverage;
providing for election of TRA retroactive overage by the eligible person in lieu
of coverage by the IRA plan, specifying certain contribution requirements;
authorizing and providing for the purchase of uncredited medical leave in the
teachers retirement association by a certain person employed by independent
school district #197, West St. Paul; authorizing and providing for the purchase
of service credit for TRA covered teachers on strike in International Falls or
Red Wing schools; authorizing and providing for the purchase of prior service
credit in the public employees retirement association (PERA) by a certain former
employee of independent school district #271, Bloomington; authorizing the
former mayor of St. Paul to reverse a previous benefit coverage election in
PERA; modifying the method for dividing public pension benefits as marital
property in marriage dissolution actions; authorizing and providing for the
purchase of prior service credit in the Minneapolis employees retirement fund
(MERF) by a certain employee of the city of Minneapolis for a certain workers
compensation injury period; authorizing and providing for certain North St. Paul
elected officials service credit purchases; authorizing and providing for the
purchase of prior service credit in the public employees police and fire plan of
the public employees retirement association (PERA) by a certain current member
of the plan formerly employed by the Eveleth police department; authorizing and
providing for the purchase of prior service and salary credit in the teachers
retirement association by a certain person employed by independent school
district #831, Forest Lake for uncredited extended leave
(rt)
