additional fees on animal feedlot operations; requiring PCA annual performance
reports to specify the amount of lead, mercury and cadmium contained in sewage
biosolids spread on land after wastewater treatment; authorizing the
commissioner of natural resources to enter into a lease with the Minneapolis
park and recreation board for the golf course and polo grounds at Fort Snelling;
specifying an ethanol producer total payments limit; specifying certain data
availability, project, match, recycled materials purchase, energy conservation,
accessibility and year compatibility requirements and payment conditions for the
Minnesota resources projects and extending the availability of appropriations
for certain projects; providing for certain funds transfers; creating an
agricultural fund with certain account divisions for deposit of receipts from
agricultural related fees and activities, specifying certain commissioner of
agriculture semiannual reporting requirements; authorizing the commissioners of
the PCA or DNR to negotiate contract terms providing for prepayment of federal
contracts; expanding the membership of the shared savings loan program loan
review panel and the technical review panel for sustainable agriculture
demonstration grants to include organic farmers and of the feedlot and manure
management advisory committee to include commercial manure applicators;
increasing the amount of the balance in the water pollution control revolving
fund authorized to be appropriated to the commissioner of agriculture for the
agricultural best management practices loan program; prohibiting agricultural
production contracts from containing provisions prohibiting producers from
disclosing terms, conditions and prices contained in the contract; providing for
the imposition of criminal and administrative penalties for packer and stockyard
violations; authorizing the commissioner to exempt certain pesticides from
registration requirements; expanding eligibility for agricultural chemical
response reimbursements to owners of all municipal airports affected by licensed
aerial pesticide applicator incidents, specifying the nonliability of airport
owners for expenses to cover necessary corrective actions caused by applicators;
requiring the commissioner to enter into agreements before a certain date
delegating licensing and inspection duties relating to retail grocery or
convenience stores to local boards of health, exempting stores inspected under
the state meat inspection program, specifying certain agreement and ordinance
requirements; increasing certain food handler license fees and imposing
certificate fees on food establishments exporting food from the state; updating
state meat and poultry rules to federal regulations; imposing certain organic
agriculture promotion duties on the commissioner and modifying the membership
and extending the expiration date of the Minnesota organic advisory task force;
providing for poultry inspection under the meat inspection law; specifying
certain reporting requirements of packers purchasing or receiving livestock for
slaughter; providing a temporary permit status for milk producers testing
positive for residue in milk shipments, requiring permit suspension for
noncompliance with certain residue prevention requirements within the temporary
permit status period; changing the executive secretary of the animal health
board to the executive director and authorizing the board to implement for
federal voluntary Johne's disease herd status program for cattle; requiring the
deposit of repayments of assistance under the ethanol production facility loan
program into the general fund; authorizing DNR electronic and telephone
transactions outside the state and sale or licensing of intellectual property
and software products or services developed by the department or custom
developed by a vendor for the department; defining metal traction device for
snowmobile regulation purposes; providing for the issuance of duplicate state
trail stickers for lost or destroyed stickers, fee; including the maintenance of
trails on lands and waters of Voyageurs national park under the snowmobile grant
in aid program, liability immunity provision; modifying the snowmobile
information and safety education and training program fee and placing certain
older youth under adult snowmobile safety training requirements; modifying the
prohibition on the use of snowmobiles with metal traction devices and specifying
certain temporary sticker requirements; modifying certain drivers license
possession requirements for and operation authority of youthful snowmobile
operators; prescribing misdemeanor penalties for persons operating snowmobiles
or all-terrain vehicles during periods of motor vehicle operation prohibition
due to driving while under influence of alcohol or controlled substance;
providing for the funding of Minnesota conservation corps projects; adding
certain lands to Blue Mounds state park and to the iron range off-highway
vehicle recreation area in St. Louis county, expanding the membership of the
advisory committee, providing for the possible operation of mining activities in
the area and specifying certain management plan development requirements;
extending the Douglas trail system and establishing the Gitchi-Gami trail in
Lake and Cook counties; modifying the limit on grants for local park and
recreation areas and requiring the commissioner of natural resources to
administer programs to provide grants to local government units for regional
trails and local trail connections; modifying certain cross country ski pass
requirements and increasing the fees; increasing certain watercraft license
fees; authorizing grants to local fire departments for procurement of fire
suppression equipment; modifying the membership, meeting and reporting
requirements of the Minnesota forest resources council; modifying certain timber
harvesting and forest management guidelines and requiring peer review and the
monitoring of riparian forests; expanding the duties of regional forest resource
committees and specifying certain council reporting requirements relating to
committee activities and certain sustainable forest management continuing
education requirements of timber harvesters and forest resource professionals;
specifying certain commissioner evaluation requirements for legislative
authorization of the sale of state lands bordering public waters; modifying
certain provisions providing for the use of proceeds from the lease of permanent
school fund lands; modifying certain firearms safety certificate or drivers
license designation requirements for hunting license issuance purposes;
prohibiting the appointment of local government unit staff members of watershed
management organizations to watershed management organization boards;
authorizing the enrollment of certain land in more than one state or federal
conservation reserve program under certain conditions; eliminating a certain
once through cooling system fee deposit requirement; providing for a stream
protection and improvement loan program; expanding certain individual sewage
treatment system inspection requirements; expanding the purpose of the waste
management act; requiring the commissioner of finance to annually transfer
certain amounts of money from the motor vehicle transfer account to the
environmental response, compensation and compliance account (superfund) and the
general fund; modifying and expanding the definition of qualified facility under
the landfill cleanup program and expanding certain program requirements relating
to qualified facilities; extending the deadline for applications for exclusion
from the program for certain qualified facilities; expanding authorized uses of
the solid waste fund; establishing the closed landfill investment fund and
providing for use; requiring legislative approval of new fees on animal
feedlots; specifying certain requirements for PCA issuance of administrative
penalty orders to feedlot operators for first time violations; authorizing
conservation officers to issue citations to persons failing to report or recover
oil or hazardous substance discharges or failing to take discharge preventive or
preparedness measures and specifying penalty amounts; requiring the commissioner
of the PCA to implement certain mercury reduction strategies; modifying certain
provisions providing for the licensing and regulation of the practice of
veterinary medicine by the board of veterinary medicine; including the
revocation of snowmobile, ATV or motorboat operating privileges in the
definition of prior license revocation for DWI purposes; modifying the
disposition of proceeds from vehicle forfeiture sales; specifying certain
content requirements of snowmobile and firearms safety certificate records
transmitted from the DNR to the commissioner of public safety for drivers
license designation purposes, authorizing the deletion of unmatched records
after a certain number of years; authorizing the bulk delivery of nonoxygenated
gasoline for certain riparian landowners and aircraft operators under certain
conditions, requiring certain retail gasoline stations to register to sell
nonoxygenated gasoline during certain months; expanding certain nongame wildlife
management account crediting requirements relating to the income tax checkoff;
eliminating the reduction in the percentage of gasoline determined to be used as
fuel for the operation of snowmobiles for gasoline tax apportionment purposes;
modifying certain reporting requirements of the commissioner of revenue relating
to solid waste management tax receipts; requiring nongovernment sites for
collection of used motor oil and filters; requiring the office of environmental
assistance and the PCA to educate the public and businesses on the proper
management of automobile wastes, providing for funding of the education program
and for a PCA analysis of used oil filter disposal methods, expanding the
liability exemption for the acceptance of used motor oil to retailers and
manufacturers contracting for the services; defining demonstration corporation
under the corporate farming law as a nonprofit corporation law formed to
demonstrate historical farming practices; expanding forestry development
projects to natural resource development projects under contractors bond
provisions; delaying the repeal of the sustainable forest resources act;
modifying a certain provision governing used motor oil and filter recycling
goals and actions; delaying the effective date of updated feedlot rules;
modifying the allocation of a certain prior appropriation to Anoka county to
construct a pedestrian tunnel and bridge; modifying the match requirements for a
certain grant by the commissioner of natural resources for the Beaver Island
trail in Stearns county; modifying a certain provision providing for the private
sale of certain surplus state land in St. Louis county; authorizing and
providing for the private sale of certain surplus state land in Rock county;
requiring the commissioner of the PCA to convene a committee to address the need
for central collection wastewater treatment systems in unsewered areas and to
report the results to the legislature by a certain date; requiring the
commissioner of agriculture to conduct an aerial applicator liability study and
report to the legislature by a certain date; rescinding a certain previous order
of the commissioner of natural resources designating certain lands as wildlife
management areas; prohibiting the construction of athletic fields within the
lower Phalen watershed area in St. Paul approved for inclusion in the metro
greenways program; requiring the board of water and soil resources to add
farmstead windbreaks as a practice eligible for cost sharing to the rules
governing erosion control cost sharing contracts; requiring the commissioner of
natural resources to amend proposed permanent rules relating to public use of
recreational areas; requiring the commissioner of agriculture to study current
and projected impacts of increasing amounts of livestock, poultry and specialty
crops produced under contract with processors and the effect on access to
competitive markets for producers choosing not to produce under contract and
report to the legislature by a certain date; specifying certain renumbering
instructions to the revisor of statutes; repealing certain provisions regulating
the sale, lease or loan of cattle not vaccinated against brucellosis and
