2E Regulating payroll cards and payroll card accounts under the fair labor
standards act, defining payroll card and payroll card account; specifying
certain payroll card issuer name and address filing requirements, requiring
filing with the commissioner of labor and industry; providing for employee
ownership of wages; requiring payroll card issuers to allow employees choosing
to receive wages through electronic fund transfer to payroll card accounts to
withdraw by free transaction from the accounts; requiring employers offering the
option of receiving wages through the accounts to disclose wage payment options
and fees to employees; requiring employee consent to electronic fund transfers
to the accounts, prohibiting consent as a condition of employment; requiring
employers to provide employees with free transaction histories upon request;
prohibiting payroll card or account links to credit and restricting access to
personal information; specifying a certain other language requirement; providing
for employee requests to change the wage payment method; prohibiting employer
charging of fees to employees for payment by electronic fund transfer and
limiting payroll deductions; imposing a penalty for violation; expanding the
definition of wage under the fair labor standards act to electronic fund
transfers to the accounts; requiring the commissioner to report to the
legislature by a certain date on the use of payroll cards
