2E Modifying provisions relating to wetland conservation; modifying certain
agency service application requirements; authorizing the board of water and soil
resources (BOWSR) to issue penalty orders for certain violations; authorizing
local government units to require a deed restriction for certain drained
wetlands, prohibiting ponds created for stormwater management requirements from
being used to satisfy replacement requirements; modifying certain wetland
replacement siting requirements; modifying certain replacement plan exemptions
for agricultural activities, drainage, federal approvals, utilities and public
works; modifying de minimis footage requirements; authorizing the board to
develop rules addressing the application and implementation of exemptions and
providing for estimates and reporting of exempt wetland impacts; authorizing the
board to develop a professional wetland delineator certification program;
specifying certain procedures for wetland boundary or type determination appeals
of decisions to local government units; modifying appeal requirements; requiring
the board to establish a fee schedule to defray certain administrative costs of
appeals; modifying local comprehensive wetland protection and management plan
content requirements; granting the board certain rulemaking authority;
appropriating money to the board to support implementation of the wetland
conservation act, to make grants to local units of governments to improve
response to major wetland violations, to provide certain oversight and technical
support to local governments, staff to monitor and enforce wetland replacement
and wetland bank sites, to develop a comprehensive state wetland restoration
vision and plan, to inventory wetland mitigation opportunities and water quality
and watershed improvement projects and to conduct a region wide wetland
mitigation siting analysis for northeastern Minnesota; repealing a certain
provision relating to approved development exemptions
