process and program to provide training and education to licensed nursing
facility providers before surveying, specifying certain process component
requirements; requiring the commissioner upon request to make available to
nursing home associations and the public certain information relating to federal
certification surveys, authorizing a document reproduction charge; requiring the
commissioner to grant waivers for continuation of approved nurse aide training
and competency evaluation programs losing approval; restricting commissioner
issuance of findings of immediate jeopardy; requiring the commissioner to by a
certain date work with providers to examine state and federal rules and
regulations governing the provision of care in licensed nursing facilities and
to apply for certain federal waivers; applying certain nursing care standards to
licensed facilities; appropriating money to the commissioner for clinical data
collection and research relating to patient falls and the use of physical
restraints and to the quality of care in hospitals, outpatient surgical centers,
boarding care and nursing homes and home care agencies, specifying certain
