A bill for an act
relating to child care; limiting access to child care center facilities; proposing
coding for new law in Minnesota Statutes, chapter 142B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Except as required by state or federal law or as required to administer a state or federally
supported child care program, the director, staff persons, substitutes, and unsupervised
volunteers of a licensed child care center or certified license-exempt child care center must
not allow a federal agent employed directly by the United States Department of Homeland
Security or employed by United States Immigration and Customs Enforcement, United
States Customs and Border Protection, or United States Citizenship and Immigration Services
to enter a child care center for any purpose without providing valid identification, a written
statement of purpose, and a valid judicial warrant and receiving approval from the child
care center license holder. If a federal agent meets the requirements under this subdivision,
the child care center must limit access to areas where children are not present.
