A bill for an act
relating to cannabis; establishing THC potency limits for cannabis concentrate,
cannabis flower, topical or transdermal cannabis products, and topical or
transdermal hemp products; requiring warning notices at retail locations of cannabis
and hemp businesses; requiring warning statements on labeling affixed to cannabis
and hemp products; amending Minnesota Statutes 2024, sections 342.01, by adding
subdivisions; 342.06, subdivision 1; 342.27, subdivision 6; Minnesota Statutes
2025 Supplement, section 342.63, subdivisions 2, 3.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2024, section 342.01, is amended by adding a subdivision
to read:

"Preroll" means a product containing cannabis or hemp that is
manufactured as a smokable unit ready-made for igniting.

Sec. 2.
Minnesota Statutes 2024, section 342.01, is amended by adding a subdivision to
read:

"Substance use disorder" has the meaning given
in section 245F.02, subdivision 24.

Sec. 3.
Minnesota Statutes 2024, section 342.06, subdivision 1, is amended to read:
Subdivision 1.
Approval of cannabis flower and products.
(a) For the purposes of
this section, "product category" means a type of product that may be sold in different sizes,
distinct packaging, or at various prices but is still created using the same manufacturing or
agricultural processes. A new or additional stock keeping unit (SKU) or Universal Product
Code (UPC) shall not prevent a product from being considered the same type as another
unit. All other terms have the meanings provided in section 342.01.
(b) The office shall approve product categories of cannabis flower, cannabis products,
lower-potency hemp edibles, and hemp-derived consumer products for retail sale.

"total THC" means the sum of the percentage by weight of tetrahydrocannabinolic acid
multiplied by 0.877 plus the percentage by weight of all tetrahydrocannabinols.new text begin The office
must enforce the following THC content limits:

(1) cannabis flower marketed for sale in the adult-use market must not contain more
than 15 percent total THC;

new text begin
(2) cannabis concentrate, either liquid or solid, marketed for sale in the adult-use market
must not contain more than 30 percent total THC; and

(3) topical or transdermal cannabis products and topical or transdermal hemp products
marketed for sale must not contain more than 500 milligrams of total THC per package.

(d) The office must not approve the following for sale in the adult-use market:
new text end
new text begin
(1) cannabis flower that have been infused with additional THC or other psychoactive
cannabinoids; or
new text end
new text begin
(2) prerolls, as defined in section 342.01, subdivision 61a, that have been infused with
additional THC or other psychoactive cannabinoids.

or hemp-derived consumer product that:

(2) bears the likeness or contains characteristics of a real or fictional person, animal, or
fruit;
(3) is modeled after a type or brand of products primarily consumed by or marketed to
children;
(4) is substantively similar to a meat food product; poultry food product as defined in
section 31A.02, subdivision 10; or a dairy product as defined in section 32D.01, subdivision
7;
(5) contains a synthetic cannabinoid;
(6) is made by applying a cannabinoid, including but not limited to an artificially derived
cannabinoid, to a finished food product that does not contain cannabinoids and is sold to
consumers, including but not limited to a candy or snack food; or
(7) if the product is an edible cannabis product or lower-potency hemp edible, contains
an ingredient, other than a cannabinoid, that is not approved by the United States Food and
Drug Administration for use in food.
Sec. 4.
Minnesota Statutes 2024, section 342.27, subdivision 6, is amended to read:
Subd. 6.
Posting of notices.
A cannabis business with a license or new text begin an new text end endorsement
authorizing the retail sale of cannabis flower or cannabis products must post all notices new text begin at
each retail location of the business new text end as required by the office, including but not limited to:
(1) information about any product recall;
(2) a statement that operating a motor vehicle under the influence of intoxicating
cannabinoids is illegal; deleted text begin and

(3) a statement that cannabis flower, cannabis products, lower-potency hemp edibles,
and hemp-derived consumer products are only intended for consumption by individuals
who are at least 21 years of agedeleted text begin .deleted text end new text begin ;

(4) "WARNING: The smoke from cannabis includes toxic chemicals that increase your
risk of heart and lung disease. The more often you smoke, the greater the risk.";

(5) "WARNING: Cannabis can cause psychotic symptoms like severe paranoia. The
risk is greatest in people younger than age 25 or when using cannabis products higher in
THC.";

(6) "WARNING: It can take up to four hours to feel effects from eating or drinking
cannabis products. Consuming more before feeling an effect can cause cannabis poisoning,
including severe anxiety and panic attacks.";

(7) "WARNING: The higher the THC in a cannabis product, the greater the risk of
adverse effects. These effects can include paranoia, anxiety, and dependence."; and

new text begin
(8) "WARNING: Do not swallow or apply topical cannabis products internally or to
broken, irritated, or itching skin. There may be health effects and risks from cannabis topical
products that are not fully known or understood.".

Sec. 5.
Minnesota Statutes 2025 Supplement, section 342.63, subdivision 2, is amended
to read:
Subd. 2.
Content of label; cannabis.
All cannabis flower and hemp-derived consumer
products that consist of hemp plant parts sold to customers or patients must have affixed
on the packaging or container of the cannabis flower or hemp-derived consumer product a
label that contains at least the following information:
(1) the name and license number of the cannabis microbusiness, cannabis mezzobusiness,
cannabis cultivator, medical cannabis combination business, or industrial hemp grower
where the cannabis flower or hemp plant part was cultivated;
(2) the net weight of cannabis flower or hemp plant parts in the package or container;
(3) the batch number;
(4) the cannabinoid profile;
(5) a universal symbol established by the office indicating that the package or container
contains cannabis flower, a cannabis product, a lower-potency hemp edible, or a
hemp-derived consumer product;
(6) verification that the cannabis flower or hemp plant part was tested according to
section 342.61 and that the cannabis flower or hemp plant part complies with the applicable
standards;
(7) information on the usage of the cannabis flower or hemp-derived consumer product;

Cannabis can worsen your attention, concentration, and memory, especially when using
cannabis every day or most days.";

like psychosis and schizophrenia. The more often you use, the greater the risk.";

(iv) "WARNING: Using cannabis every day or most days can lead to dependence or
addiction. The higher the THC dose, the greater the risk. Dependence also increases your
risk of anxiety and depression.";

(v) "WARNING: Do not use cannabis if pregnant or breast feeding. Using cannabis can
harm your baby's growth and development."; and

(vi) "WARNING: Do not drive under the influence of cannabis. It puts your life and
other people's lives at risk."; and

(9) any other statements or information required by the office.
Sec. 6.
Minnesota Statutes 2025 Supplement, section 342.63, subdivision 3, is amended
to read:
Subd. 3.
Content of label; cannabinoid products.
(a) All cannabis products,
lower-potency hemp edibles, hemp concentrate, hemp-derived consumer products other
than products subject to the requirements under subdivision 2, medical cannabinoid products,
and hemp-derived topical products sold to customers or patients must have affixed to the
packaging or container of the cannabis product a label that contains at least the following
information:
(1) the name and license number of the cannabis microbusiness, cannabis mezzobusiness,
cannabis cultivator, medical cannabis combination business, or industrial hemp grower that
cultivated the cannabis flower or hemp plant parts used in the cannabis product,
lower-potency hemp edible, hemp-derived consumer product, or medical cannabinoid
product;
(2) the name and license number of the cannabis microbusiness, cannabis mezzobusiness,
cannabis manufacturer, lower-potency hemp edible manufacturer, medical cannabis
combination business, or industrial hemp grower that manufactured the cannabis concentrate,
hemp concentrate, or artificially derived cannabinoid and, if different, the name and license
number of the cannabis microbusiness, cannabis mezzobusiness, cannabis manufacturer,
lower-potency hemp edible manufacturer, or medical cannabis combination business that
manufactured the product;
(3) the net weight of the cannabis product, lower-potency hemp edible, or hemp-derived
consumer product in the package or container;
(4) the type of cannabis product, lower-potency hemp edible, or hemp-derived consumer
product;
(5) the batch number;
(6) the serving size;
(7) the cannabinoid profile per serving and in total;
(8) a list of ingredients;
(9) a universal symbol established by the office indicating that the package or container
contains cannabis flower, a cannabis product, a lower-potency hemp edible, or a
hemp-derived consumer product;
(10) a warning symbol developed by the office in consultation with the commissioner
of health and the Minnesota Poison Control System that:
(i) is at least three-quarters of an inch tall and six-tenths of an inch wide;
(ii) is in a highly visible color;
(iii) includes a visual element that is commonly understood to mean a person should
stop;
(iv) indicates that the product is not for children; and
(v) includes the phone number of the Minnesota Poison Control System;
(11) verification that the cannabis product, lower-potency hemp edible, hemp-derived
consumer product, or medical cannabinoid product was tested according to section 342.61
and that the cannabis product, lower-potency hemp edible, hemp-derived consumer product,
or medical cannabinoid product complies with the applicable standards;
(12) information on the usage of the product;

(b) The office may by rule establish alternative labeling requirements for lower-potency
hemp edibles that are imported into the state if those requirements provide consumers with
information that is substantially similar to the information described in paragraph (a).
