A bill for an act
relating to aeronautics; requiring certain use of a transponder in aircraft flight;
amending Minnesota Statutes 2024, section 360.018, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2024, section 360.018, is amended by adding a subdivision
to read:

new text begin Aircraft operation; transponder. new text end

new text begin (a) No person may operate an aircraft in
the navigable air space overlying the state without an operable and activated transponder
that automatically transmits responses to air traffic control radar interrogation.

new text begin (b) In consultation with the commissioner of public safety, the commissioner may issue
an exemption from the requirements under this subdivision upon making a determination
of cause due to an identified compelling security concern or extraordinary circumstances.
Each exemption must be:

new text begin (1) by application submitted in the manner specified by the commissioner;
new text end

new text begin (2) for operation of a single aircraft on a specified date; and
new text end

new text begin (3) limited to (i) a geographic area only as necessary for the purposes of the flight, and
(ii) a period that does not exceed the necessary flight time between two identified locations
or the duration of an identified activity necessitating the exemption.
