A bill for an act
relating to transportation; establishing a supplemental anatomical gift education
program; providing for certain credits on driver's license and Minnesota
identification card fees; amending Minnesota Statutes 2024, sections 171.06,
subdivision 2; 171.075.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2024, section 171.06, subdivision 2, is amended to read:

Fees.

(a) The fees for a license and Minnesota identification card are as follows:

(b) In addition to each fee required in paragraph (a), the commissioner must collect a
surcharge of $2.25. Surcharges collected under this paragraph must be credited to the driver
and vehicle services technology account under section 299A.705.

(c) Notwithstanding paragraph (a), an individual who holds a provisional license and
has a driving record free of (1) convictions for a violation of section 169A.20, 169A.33,
169A.35, sections 169A.50 to 169A.53, or section 171.177, (2) convictions for crash-related
moving violations, and (3) convictions for moving violations that are not crash related, has
a $3.50 credit toward the fee for any classified under-21 driver's license. "Moving violation"
has the meaning given it in section 171.04, subdivision 1.

new text begin (d) Notwithstanding paragraph (a), an adult applicant has a credit toward the fee for a
new or renewal driver's license or Minnesota identification card if the person submits a
course completion certificate for the supplemental anatomical gift education program under
section 171.075, subdivision 3. The credit is calculated as 50 percent of the amount otherwise
applicable under paragraph (a), with the resulting fee rounded up to the nearest increment
of $0.25. The credit does not apply to an application for an instruction permit, commercial
learner's permit, provisional license, or duplicate credential.

commissioner must collect an additional $4 processing fee from each new applicant or
individual renewing a license with a school bus endorsement to cover the costs for processing
an applicant's initial and biennial physical examination certificate. The department must
not charge these applicants any other fee to receive or renew the endorsement.

Sec. 2.

Minnesota Statutes 2024, section 171.075, is amended to read:


171.075 ANATOMICAL GIFTS.

Subdivision 1.

Anatomical gift account.

An anatomical gift account is established in
the special revenue fund. The account consists of funds donated under sections 168.013,
subdivision 22, and 171.06, subdivision 2, and any other money donated, allotted, transferred,
or otherwise provided to the account. Money in the account is annually appropriated to the
commissioner for (1) grants under subdivision 2, deleted text begin anddeleted text end (2)new text begin the supplemental anatomical gift
education program under subdivision 3, and (3)
new text end administrative expenses in implementing
the deleted text begin donation and grant programdeleted text end new text begin requirements under this sectionnew text end .

Subd. 2.

Anatomical gift education grants.

(a) The commissioner deleted text begin shalldeleted text end new text begin mustnew text end make
grants to (1) a Minnesota organ procurement organization that is certified by the federal
Centers for Medicare and Medicaid Services; or (2) an entity that is a charitable entity under
section 501(c)(3) of the Internal Revenue Code, as defined in section 289A.02, subdivision
7, and is dedicated to advocacy for organ, tissue, and eye donation.

(b) From a grant under this section, the recipient deleted text begin shalldeleted text end new text begin mustnew text end provide resources and
implement programs designed to increase the number of Minnesotans who register to be
organ, tissue, and eye donors.

new text begin Supplemental anatomical gift education program. new text end

new text begin (a) The commissioner
must establish a supplemental education program on organ, tissue, and eye donation for
adult driver's license or Minnesota identification card applicants and credential holders. In
implementing the education program, the commissioner must:

new text begin (1) establish procedures and requirements for the education program, including to:
new text end

new text begin (i) authorize both in-person and online asynchronous program offerings;
new text end

new text begin (ii) require at least one hour and not more than two hours of instruction;
new text end

new text begin (iii) incorporate accountability features to verify the identity of a participant while
engaged in the course of online instruction;
new text end

new text begin (iv) require knowledge testing before commencing and at completion of the course of
instruction; and
new text end

new text begin (v) provide for issuance of a course completion certificate to a driver's license holder
who completes the course of instruction;
new text end

new text begin (2) enter into an agreement with interested nonprofit organizations with expertise on
organ, tissue, and eye donation for the organizations to:
new text end

new text begin (i) perform the curriculum design;
new text end

new text begin (ii) administer the course of instruction, which must include providing regular program
offerings at locations throughout the state and in partnership with interested public and
private entities as necessary; and
new text end

new text begin (iii) perform annual review and revision to the instructional content and materials; and
new text end

new text begin (3) evaluate the results of knowledge testing under clause (1), item (iv), and program
impacts on applications to make an anatomical gift and make program modifications
accordingly.

new text begin (b) At a minimum, the curriculum for the course of education must include:
new text end

new text begin (1) general information about organ, tissue, and eye donation and the donation process;
new text end

new text begin (2) information on Minnesota laws regarding anatomical gifts;
new text end

new text begin (3) review of common questions and misconceptions; and
new text end

new text begin (4) examples of the direct experience of individuals impacted by organ, tissue, and eye
donation.
